TRENDS OF JUDICIALIZATION IN THE EDUCATION OF PEOPLE WITH DISABILITIES

Resumo: The defense of public education and school as a right of the entire population is a movement permeated by social, political and economic interests and clashes. In the context of Brazilian constitutionalism, with the expansion of access to justice, there is a growing role of the Judiciary in the materialization of the right to education. Considering this phenomenon and following the lawsuits regarding the education of students with disabilities, we aim to characterize the lawsuits concerning Special Education filed in a district of the Court of Justice of the State of São Paulo. It seeks to identify the main requests and Court decisions handed down, to analyze the trends of judicialization in this area. The results indicate that, although the medical report is configured as the main guide for judicial decisions and the actions handed down are of an individual nature, the fact that there is an expert pedagogical evaluation in the process can open other gaps in the realization of the right to school education.

No contexto do constitucionalismo brasileiro, com a expansão do acesso à justiça, há uma crescente atuação do Poder Judiciário na materialização do direito à educação. Considerando esse fenômeno e acompanhando as demandas judiciais referentes à educação de estudantes com deficiência, temos como objetivo caracterizar as ações judiciais que concernem à Educação Especial ajuizadas em uma comarca do Tribunal de Justiça do Estado de São Paulo. Busca-se identificar as principais solicitações e as decisões judiciais proferidas, a fim de analisar as tendências da judicialização nessa área.
