The deontological morality as a synthesis of the soul and forms of the liberal state

Resumo: Objective with this paper presents the thesis that the moral ethics of Kant, is characterized by the synthesis between the theories: natural law, the separation of powers, and, of popular sovereignty. Accordingly, if on the one hand, the concern of natural law was to separate morality and legality, being the first domestic legislation and a second external legislation, on the other, Kant’s concern was to create ways of reconciling forum internum and forum externum, combining the strength and consensus on a single process through which individuals would submit to power up not because they would feel compelled to do so, but because the moral action would lead inescapably to that path. If the thought jusnaturalist observed that men move from self-love, for the purpose of self and selfish interests are governed by oppositional character, and the contract the sum of all individual interests, in Kant, the individual, understood as rational subject in general staff and guides his actions by the principle of autonomous will as supreme legislator. Therefore, the normative legal order in which the contract staff is to be understood not as external moment that requires the individual to coercion, but as internal momentum, by which the individual makes of his action the moment of manifestation of his will in way of enacting a universal law.

Objetiva-se com este Artigo apresentar a tese de que a moral deontológica de Kant, caracteriza-se por ser a síntese entre as teorias: do direito natural; da separação dos poderes; e, da soberania popular. Nestes termos, se, por um lado, a preocupação dos jusnaturalistas era a de separar moralidade e legalidade, cabendo a primeira uma legislação interna e a segunda uma legislação externa, por outro, a preocupação de Kant era a de criar formas de conciliação entre forum internum e forum externum, conciliando força e consenso em um mesmo processo, através do qual os indivíduos se submeteriam ao poder instituído não porque se sentiriam compelidos a isso, mas porque a ação moral os levaria inapelavelmente a tal caminho. Se no pensamento jusnaturalista se observa que os homens se movem por amor-próprio, com a finalidade de autoconservação e se pautam por interesses egoísticos de caráter negativista, sendo o contrato a soma de todos os interesses individuais; em Kant, o indivíduo, compreendido enquanto sujeito racional em geral pauta e orienta suas ações pelo princípio da vontade autônoma enquanto suprema legisladora. Portanto, o ordenamento normativo jurídico no qual se pauta o contrato passa a ser compreendido não enquanto momento externo que se impõe ao indivíduo de forma coercitiva, mas enquanto momento interno, pelo qual o indivíduo faz de sua ação o momento de exteriorização de sua vontade na forma promulgadora de uma legislação universal.
