The exhaustion of the multilateral trading system: loss of legitimacy and challenges to governance

Resumo: | This paper aims to analyze the current crisis of the Multilateral Trading System, from the perspective by which there has been a significant raise in the number of Preferential Trade Agreements (PTAs) signed among its Member States. The question that comes into mind is whether the World Trade Organization - WTO will be able to overcome the obstacles that block the organization’s growth, since the PTAs, not only regulate issues that are untouched by the organism, but also have been creating their own mechanisms, as, for instance, trade disputes. The raising complexity of both economic and trade relations explains, nevertheless, the system’s crisis and its lack of legitimacy. There is an institutional emptying within the WTO. In this sense, it is also necessary to evaluate the consequences of the current trade situation over Brazil’s interests. |

Este artigo analisa a atual crise do Sistema Multilateral de Comércio, a partir da percepção de que houve um aumento significativo no número de Acordos Preferenciais de Comércio (APCs) assinados entre seus Estados membros. Questiona-se, a partir disso, se a Organização Mundial de Comércio – OMC, principal organismo regulatório do sistema multilateral, poderá superar os obstáculos que se colocam ao seu desenvolvimento, uma vez que os APCs além de regularem temas intocados pela organização têm criado mecanismos próprios, como, por exemplo, para solução de controvérsias. O aumento da complexidade das relações econômicas e comerciais explica, portanto, a crise do sistema e sua consequente perda de legitimidade. Está em curso um processo de esvaziamento institucional da OMC.
