Resumo: The concept of family has evolved, following the evolution of society and the new forms of relationship between people. Similarly, the notion of affiliation has also evolved, mainly with the introduction of assisted human reproduction techniques, constantly developed by science, and which have direct consequences on law and on bio-law. In fact, the desire to have a child permeates important aspects of the person and makes science create techniques that make this possible, even after the person's death. In that there is assisted posthumous or post-mortem reproduction, a technique in which the implantation of the genetic material or the cryopreserved embryo is carried out after the death of the spouse/partner, which brings a series of consequences, problems and discussions in the field of psychology, sociology, and, mainly, bioethics, bio-law and law. Specifically, this work aims to bring to discussion the social security effects of posthumous assisted reproduction. Da mesma forma, a noção de filiação também evoluiu, principalmente com a introdução de técnicas de reprodução humana assistidas, constantemente desenvolvidas pela ciência, e que geram consequências diretas no direito e no biodireito. Em verdade, o desejo de gerar um filho permeia aspectos importante da pessoa e faz com que a ciência crie técnicas que tornam isso possível, até mesmo para depois da morte da pessoa. Nisso se tem a reprodução assistida póstuma ou post mortem, técnica em que se tem a implantação do material genético ou do embrião criopreservado após a morte do cônjuge/companheiro, o que traz uma série de consequências, problemas e discussões no campo da psicologia, da sociologia, e, principalmente, da bioética, do biodireito e no direito. No específico, este trabalho visa trazer à discussão os efeitos previdenciários da reprodução assistida post mortem.
