Resumo: | The concept of family has evolved, following the evolution of society and the new forms of relationship between people. Similarly, the notion of affiliation has also evolved, mainly with the introduction of assisted human reproduction techniques, constantly developed by science, and which have direct consequences on law and on bio-law. In fact, the desire to have a child permeates important aspects of the person and makes science create techniques that make this possible, even after the person's death. In that there is assisted posthumous or post-mortem reproduction, a technique in which the implantation of the genetic material or the cryopreserved embryo is carried out after the death of the spouse/partner, which brings a series of consequences, problems and discussions in the field of psychology, sociology, and, mainly, bioethics, bio-law and law. Specifically, this work aims to bring to discussion the social security effects of posthumous assisted reproduction. Keywords: family; affiliation; post-mortem assisted human reproduction; social security effects; death pension. |

HUMAN ASSISTED REPRODUCTION POST MORTEM: : A BRIEF DISCUSSION ON ISSUES BIOETHICAL, LEGAL AND SOCIAL SECURITYREPRODUÇÃO HUMANA ASSISTIDA POST MORTEM: : UMA BREVE DISCUSSÃO SOBRE SEUS ASPECTOS BIOÉTICOS, JURÍDICOS E PREVIDENCIÁRIOSThe concept of family has evolved, following the evolution of society and the new forms of relationship between people. Specifically, this work aims to bring to discussion the social security effects of posthumous assisted reproduction. Centro Universitário Autônomo do Brasil2022-12-22info:eu-repo/semantics/articleinfo:eu-repo/semantics/publishedVersionapplication/pdfhttps://revistaeletronicardfd.unibrasil.com.br/index.php/rdfd/article/view/218910.25192/issn.1982-0496.rdfd.v27i32189Revista Direitos Fundamentais & Democracia; v. 27 n. 3 (2022): Revista Direitos Fundamentais & Democracia; 170-196Revista Direitos Fundamentais & Democracia; Vol. 27 No. 3 (2022): Revista Direitos Fundamentais & Democracia; 170-1961982-0496reponame:Revista Direitos Fundamentais e Democraciainstname:Centro Universitário Autônomo do Brasil (UniBrasil)instacron:UNIBRASILporhttps://revistaeletronicardfd.unibrasil.com.br/index.php/rdfd/article/view/2189/758Copyright (c) 2022 Gilberto Marchetti, Juliana Ribeiro, Miguel Horvath Júniorhttps://creativecommons.org/licenses/by-nc-sa/4.0info:eu-repo/semantics/openAccessRibeiro, Juliana de Oliveira Xavier Horvath Júnior, Miguel Marchetti Filho, Gilberto Ferreira 2022-12-22T14:30:02Zoai:ojs.pkp.sfu.ca:article/2189Revistahttp://revistaeletronicardfd.unibrasil.com.br/index.php/rdfdONGhttps://revistaeletronicardfd.unibrasil.com.br/index.php/rdfd/oairevistadfd@unibrasil.com.br||ebgomes@me.com1982-04961982-0496opendoar:2022-12-22T14:30:02Revista Direitos Fundamentais e Democracia - Centro Universitário Autônomo do Brasil (UniBrasil)false |
