Resumo: The current social context of increased conflicts brought to the judiciary and the phenomenon of repetitive litigation resulting from mass demands, deepened the inefficiency of judicial provision, generating a deficit in the protection of legal relations and obdising effective access to justice. The succession of repetitive demands generates distortions in the procedural system because it expands the possibilities that identical conflicts have different solutions and treatments. To face this situation and contribute to the improvement of the judicial provision was established by the CPC 2015 the incident of resolution of repetitive claims. In this context, this article aims, in a reflexive, dialogical and punctual way, to demonstrate how the Economic Analysis of Law can be used in the context of the dogmatics of the civil process, in a dialogical-interdisciplinary relationship to analyze the theoretical-conceptual and functional structuring of incident of resolution of repetitive claims at civil procedural law. For this, the authors use bibliographical research and the critical hermeneutic method, by means of a literature review related to the theme.

For this, the authors use bibliographical research and the critical hermeneutic method, by means of a literature review related to the theme. O presente contexto social de aumento de conflitos levados ao Judiciário e o fenômeno de litigância repetitiva decorrente das demandas de massa aprofundaram a ineficiência da prestação jurisdicional, gerando um déficit na proteção às relações jurídicas e obstando o efetivo acesso à justiça. A sucessão de demandas repetitivas gera distorções no sistema processual, pois amplia as possibilidades de que conflitos idênticos tenham soluções e tratamentos diferentes. Para fazer frente a esse quadro e contribuir para o apromoramento da prestação jurisdicional foi instituído pelo CPC de 2015 o incidente de resolução de demandas repetitivas. Diante desse contexto, o presente artigo objetiva, de forma reflexiva, dialógica e pontual, demonstrar como a Análise Econômica do Direito pode ser utilizada no contexto da dogmática do processo civil, numa relação dialógico-interdisciplinar para analisar a estruturação teórico-conceitual e funcional do incidente de resoluções de demandas repetitivas no âmbito do Direito Processual Civil.
