Real Estate Wrights and its relation with the urban laid out structure and the public space: the “Puerto Interior” case, Guanajuato, México

Resumo: Nowadays, variety and complexity of the activities performed by different actors, pedestrians and vehicles, at the public space generated by the configuration of the property rights executed in the construction and the development of every piece of land with specific big scale productive purposes and productive destinations called neighborhoods, cities, corridors, industrial parks, etc, they shows confusion and doubts on the interpretation and determination of the functional characteristics controlled by the urban regulations applicable to the design of the system of roads, street sections and sidewalks, access characteristics, ways of property regime, goods management organization and common urban services, etc. The urban regulations for industrial uses, according to the General Manager of the Industrial States Mexican Association, Claudia Avila Conelly, has not been regulated in the sector because, the authorities of the federal, state and municipal levels have been lacked sensitivity to the importance of the industrial states. The only policy that we have is the Mexican Standard NMX-R-046-CFIDS-2005; however its application by individuals is voluntary. This leads in a wide variety of interpretations of the property rights rules related with the planning, management and urban administration and industrial land use permission articulated by a common pedestrian area of transition between private and public property, between the urban and architectural scale, and the current research is looking for the anthropic field, specifically in the “Puerto Interior de Guanajuato”, which is located in the Industrial Corridor of the Bajío Region.

This leads in a wide variety of interpretations of the property rights rules related with the planning, management and urban administration and industrial land use permission articulated by a common pedestrian area of transition between private and public property, between the urban and architectural scale, and the current research is looking for the anthropic field, specifically in the “Puerto Interior de Guanajuato”, which is located in the Industrial Corridor of the Bajío Region.  En la actualidad, la variedad y complejidad de las actividades que realizan en el espacio público los diferentes actores, peatonales y vehiculares, generan una determinada configuración propiciada por el ejercicio de los derechos de propiedad materializados en la edificación y urbanización de predios con usos y destinos productivos a gran escala, denominados fraccionamientos, ciudades, corredores, parques industriales, etc., muestran confusión e incertidumbre en la interpretación y determinación de las características funcionales reguladas por la normatividad urbana aplicable al diseño de vialidades, secciones de calles y banquetas, características de accesos, modalidades de régimen de propiedad, organismos administradores de los bienes y servicios urbanos comunes, etc. La normatividad urbana para usos industriales, de acuerdo a la Directora General de la Asociación Mexicana de Parques Industriales Privados, Claudia Ávila Conelly, no ha sido reglamentada en el sector debido a que, a las autoridades de los ámbitos federal, estatal y municipal, les ha faltado sensibilidad respecto a la trascendencia de los parques industriales. El instrumento normativo con que se cuenta es la Norma Mexicana NMX-R-046-SFCI-2005; sin embargo, su aplicación por parte de los particulares es voluntaria.
