The relations between culture and politics in postmodernity:: reflections on ‘gay marriage’

| Resumo: | In recent years, the demands surrounding the legal recognition of same-sex unions have gained high visibility in the political debate in several countries around the world. This text proposes to reflect on the intricate and complex relations between culture and politics based on the analysis of the themes of citizenship, sexual rights and, more specifically, on the controversy surrounding "gay marriage". Based on the academic debate and preliminary results of the doctoral research I am currently developing in Brazil and South Africa, I will try to demonstrate how the question of the nomenclature attributed in the legal texts to these unions (civil union, civil partnership or marriage) not only to the range of rights granted, but also to the symbolic status given to these unions. The text also seeks to contribute to the broader debate and reflection around guaranteeing rights and legal recognition of these “new” marital arrangements. |

Este texto propone reflexionar sobre las intrincadas y complejas relaciones entre cultura y política a partir del análisis de los temas de ciudadanía, derechos sexuales y, más específicamente, sobre la polémica en torno al “matrimonio gay”. A partir del debate académico y los resultados preliminares de la investigación doctoral que estoy desarrollando actualmente en Brasil y Sudáfrica, intentaré demostrar cómo la cuestión de la nomenclatura atribuida en los textos legales a estas uniones (unión civil, unión civil o matrimonio) no solo a la gama de derechos otorgados, sino también al estatus simbólico otorgado a estos sindicatos. El texto también busca contribuir al debate y la reflexión más amplios en torno a garantizar los derechos y el reconocimiento legal de estos “nuevos” arreglos matrimoniales.Nos últimos anos, as demandas em torno do reconhecimento legal das uniões entre pessoas do mesmo sexo têm ganhado grande visibilidade no debate político em vários países do mundo. O presente texto propõe refletir sobre as intricadas e complexas relações entre cultura e política a partir da análise das temáticas da cidadania, direitos sexuais e, mais especificamente, sobre a polêmica em torno do “casamento gay”. A partir do debate acadêmico e de resultados preliminares da pesquisa de doutorado que desenvolvo atualmente no Brasil e na África do Sul, tentarei demonstrar como a questão da nomenclatura atribuída nos textos legais a estas uniões (união civil, parceria civil ou casamento) refere-se não só ao leque de direitos concedidos, mas também ao estatuto simbólico conferido a estas uniões.
