Resumo: This article aims to analyze - albeit succinctly - the process of implementing the neoliberal adjustment policies that has been taking place in Brazil after the National Privatization Program (PND). It is based on the assumption that such measures, in the way they have been carried out, directly affect the sustainability of democracy as well as the rule of law, through the imbalance between the actions of the Legislative, Executive and Judiciary Powers. It gives a brief historical account of the emergence of neoliberal thinking to immediately identify its phases of implementation - based on the Washington Consensus - so that I can see where Brazil fits in. And, finally, it raises some data referring to recent privatization processes carried out, to expose the conflict between the Executive Branch and civil society.

Se parte del supuesto de que tales medidas, en la forma en que se han llevado a cabo, afectan directamente la sostenibilidad de la democracia y el estado de derecho, a través del desequilibrio entre las acciones de los Poderes Legislativo, Ejecutivo y Judicial. Ofrece un breve relato histórico del surgimiento del pensamiento neoliberal y luego identifica de inmediato sus fases de implementación, basadas en el Consenso de Washington, de una manera que permite ver dónde encaja Brasil. Y finalmente, plantea algunos datos referentes a los recientes procesos de privatización llevados a cabo, para exponer el conflicto entre el Poder Ejecutivo y la sociedad civil.O presente artigo tem como proposta analisar - ainda que sucintamente - o processo de implementação das políticas de ajuste neoliberal que vem ocorrendo no Brasil após o Programa Nacional de Desestatização (PND). Parte do pressuposto que tais medidas, da forma como vem sendo feitas, afetam diretamente a sustentabilidade da democracia bem como também do Estado de Direito, através do desequilíbrio entre as atuações dos Poderes Legislativo, Executivo e Judiciário. Daz um breve relato histórico do surgimento do pensamento neoliberal para logo em seguida identificar as suas fases de implementação - a partir do Consenso de Washington - de forma que torno possível ver onde que o Brasil se encaixa.
