Resumo: This article aims to address the legal relationship established between doctor and patient, with evidence of cases within medical error, and consequently, the civil liability of this professional who has caused harm to the patient. The way in which the jurisprudence has manifested itself in relation to this subject has also been addressed, and the way in which it has manifested itself about the relationship established between the doctor and the patient. The Deductive Method was used in the present study, which is the method of reasoning by which one has information, and a conclusion is made from it, so that the final results can be reached. In this method thoughts that already exist are studied, so that theories can be formed and proved.

Também é abordada a forma como a jurisprudência tem se manifestado em relação a este tema, e a maneira pela qual esta tem se manifestado acerca da relação estabelecida entre o médico e o paciente. Foi usado o Método Dedutivo no presente trabalho, que é o método de raciocínio pelo qual se tem uma informação, e dela se faz uma conclusão, para que assim se chegue aos resultados finais.
