Resumo: The objective of this work was to analyze the resourcefulness of political agents in their activities, the role of the citizen in the current Brazilian democratic scenario, systemic corruption as a violation of fundamental rights, and the threat to the democratic rule of law with the apathetic form of Brazilian society and the intemperate of political agents. The focus of the research, therefore, is to expose the collective efforts in the consolidation of the Democratic Rule of Law in Brazil, which starts with its historical context until we reach the ethical deterioration reflecting in the democratic reality, threatening the Democratic State in the face of the widespread practice of political corruption. Given the above, I tried to discuss the historical correlation of Democracy and its mutations, and the construction of Fundamental Rights, thus conceptualizing corruption and its forms, demonstrating how systemic corruption occurs in Brazil and its consequences before its representatives. The research starts from a broad and complex idea about the ideal State Law, observing the popular participation in matters related to the control of society as essential for the proper functioning of the representative democratic regime, as is the case in Brazil.

O foco da pesquisa, portanto, é expor os esforços coletivos na consolidação do Estado Democrático de Direito no Brasil, que se inicia com seu contexto histórico, até chegarmos na deterioração ética, refletindo na realidade democrática, ameaçando o Estado Democrático ante a prática generalizada da corrupção política. Diante do exposto, procurei discorrer a correlação histórica da Democracia e suas mutações, e a construção de Direitos Fundamentais, deste modo, conceituando a corrupção e suas formas, demonstrando como a corrupção sistêmica ocorre no Brasil e suas consequências diante de seus representados.
