Resumo: The beginning and the middle of 2000s was marked by the race of a new era of social interaction, with the digitization and internet advertising. The social networks come to change the relationships in all the word, they approach people, facilitate communication, help in the spread of information. But, at the same time, bring the fakes news, the hate and hostile environment, of difficult delimitation of jurisdiction, and conducive to many illegal practices and crimes. The discussion of expression freedom is new, and have many problems to solve. For this, the present article intends to discuss the expression freedom in the digital environment and the hat speech. In this way, the theoretical analysis methodology used was deductive method. Which concludes that freedom of expression in social networks is not limited, facilitating hate speech, that in other hand, the legislation tends to evolve in order to avoid violation of human dignity.

As redes sociais vieram a mudar a dinâmica de relacionamentos ao redor do mundo, trazendo o bônus de aproximar pessoas, facilitar a comunicação, ajudar na propagação de informações. Mas junto com isso veio o ônus de propagar desinformação, fomentar um ambiente muitas vezes hostil e de ódio, de difícil delimitação de jurisdição, e propício a muitas práticas ilegais e até mesmo crimes. Dentro desse cenário a discussão acerca da liberdade de expressão dentro desse ambiente é relativamente nova, e ainda cercada de muitas dúvidas e problemas a serem sanados. Para isto, o presente artigo pretende discutir a liberdade de expressão no meio digital e a discussão de ódio. Desta maneira foi utilizada a metodologia de análise teórica, ou seja, método dedutivo.
