Justiça restaurativa: o caminho para a revolução sistemática criminal

Resumo: This final paper aims to expand discussions about the theory of Restorative Justice, presenting it as a timely, plausible and efficient proposal for programming a new criminal system that actually works. For this, primarily, was clarified the concept of Restorative Justice, its sources and objectives. Posteriorly, was referred to as a topic for the premise of the importance of the victim’s participation in the criminal proceedings, bringing clarification about the problems suffered in the experience of being violated by a crime. There are scores in the sense that the psychological consequences of the trauma suffered reverberate in the victim’s life until posterity. In the following topic, the focus is on the ratification of Restorative Justice by the United Nations, which, through Resolution 2002/12, internationally recognized the justice model, developing in its content essential elements for the realization of restorative practices, taking into account the internal regulations of the signatory countries. Afterwards, starting the topic on the precariousness of the retributive system, the failure of the current penal system is proven through statistics and critical analysis of the Brazilian prison scenario, corroborating the aforementioned theses. Finally, this article concludes by highlighting the importance of reconfiguration of the current justice paradigm, presenting how Restorative Justice works in practice.

Para tanto, primordialmente, foi esclarecido o conceito de Justiça Restaurativa, suas fontes e seus objetivos. Por conseguinte, foi referido tópico para a premissa da importância da participação da vítima no processo penal, trazendo esclarecimentos acerca das mazelas sofridas na experiência de ser violada por um crime. Há pontuações no sentido de que as consequências psicológicas do trauma sofrido reverberam na vida da vítima até a posteridade. No tópico que segue, o enfoque se direciona para a ratificação da Justiça Restaurativa pela Organização das Nações Unidas, que, por meio da Resolução 2002/12, reconheceu internacionalmente o modelo de justiça, desenvolvendo em seu teor elementos essenciais para efetivação das práticas restaurativas, levando em consideração os ordenamentos internos dos países signatários. Posteriormente, iniciado o tópico sobre a precariedade do sistema retributivo, é comprovado o fracasso do sistema penal vigente por meio de estatísticas e análises críticas do cenário carcerário brasileiro, corroborando as teses mencionadas.
