Sleeping with the Enemy: Psychic Violence Against Women and Insufficient Protection by the Brazilian Law

Resumo: Due to their vulnerability and to the dignity principle of the human person, women are specifically protected in (a) International Treaties and Agreements; (b) the 1988 Brazilian Constitution; (c) Law 11340/2006 known as Maria da Penha Law. However, a mere declaration of rights is not immediately sufficient to change the violent culture against women within the home. Violence may be perceived through attitudes that violate women’s psychic and physical integrity. Violence against women has a trans-generation behavior since the victim’s children may perpetuate such a trait in the future. Although Brazilian law is highly strict, violence against women is a still current occurrence, as recent research on the subject testifies. The above-mentioned law released psychic violence from the criminal stance but judges harsher physical harassment against women. Due to escalating violence against women, the State’s intervention is required through penal law to incriminate psychic violence and thus the interruption of the violence cycle prior to the physical and fatal aggressions against women. The right of not being the object of violence will be effective worldwide when a change of mentality occurs and society takes a strict stance on the subject. This depends on effective political policies of prevention and the punishment of aggressors.

Sin embargo, la simple declaración de derechos no es suficiente para, de pronto, cambiar la realidad de la violencia contra la mujer en el entorno doméstico. Esa violencia puede ser vislumbrada por medio de actitudes que violan la integridad psicofísica de la mujer. La violencia en contra la mujer posee un carácter trasgeneracional, una vez que los hijos de la víctima, probablemente, van a desarrollar ese comportamiento en las futuras generaciones. A pesar del rigor del tratamiento normativo, la violencia en contra la mujer todavía es una triste realidad, de acuerdo con investigaciones recientes. La ley ha dejado de considerar criminosa la violencia psíquica a pesar de haber vuelto más grave la lesión corporal leve en contra la mujer. En razón del escalonamiento de la violencia psíquica la intervención del Estado se vuelve imprescindible en la elaboración de tipo penal con la finalidad de incriminar la conducta de violencia psíquica y, consecuentemente, permitir el rompimiento con el ciclo de la violencia antes que la mujer sea agredida físicamente o muerta. Por fin, se entiende que el derecho a la no violencia conferido a la mujer solo se hará efectivo en el mundo de los hechos cuando haya un cambio de mentalidad y de postura de la sociedad, que depende de políticas públicas efectivas de prevención y punición del agresor.A mulher, em razão de sua vulnerabilidade e do princípio da dignidade da pessoa humana, goza de proteção especial em (a) Tratados e Convenções Internacionais, na (b) Constituição da República Federal de 1988 e na (c) Lei n. 11.340/2006, conhecida como Lei Maria da Penha. Contudo, a mera declaração de direitos não é suficiente para, de imediato, alterar a realidade da violência contra a mulher no ambiente doméstico. Essa violência pode ser visualizada por meio de atitudes que violam a integridade psicofísica da mulher. A violência contra a mulher tem caráter transgeracional, uma vez que os filhos da vítima, provavelmente, desencadearão esse comportamento nas futuras gerações. Apesar do rigor no tratamento normativo, a violência contra a mulher ainda é uma triste realidade, conforme demonstram pesquisas recentes. A lei em comento deixou de tornar criminosa a violência psíquica apesar de ter tornado mais grave a lesão corporal leve contra a mulher. Em razão do escalonamento da violência, a intervenção do Estado se mostra imprescindível por meio de elaboração de tipo penal com o fim de incriminar a conduta de violência psíquica e, consequentemente, permitir o rompimento com o ciclo da violência antes que a mulher seja agredida fisicamente ou morta.
