The Environment and the Conflict Bet Ween Environmental Preservation and Technological Development: A Discussion on Basic Rights

Resumo: The issues between technological progress and growing concern on environmental degradation are discussed. It is highly relevant to note that these issues are the responsibility of the State and of post-modern society. Society´s economical progress depends on technological development even though its evolution may not occur to the detriment of the environment that assures the life of all living beings. It is actually a highly complex situation which demands a plausible solution in which society may continue its technological progress without forgetting the respect due to the environment and its protection. The theme also involves the horizontal efficiency of basic rights since it comprises the relationships of technology and the environment between private persons. Concern on technological progress and the preservation of the environment should be ripe for a sustainable development to attend to both human needs without jeopardizing basic rights and human dignity which are a must for human survival.

Se percibe que estas son cuestiones de cuyo tratamiento tanto el Estado como la sociedad post-moderna no pueden omitirse. El progreso económico de la sociedad también depende del desarrollo tecnológico. Sin embargo, no se puede admitir su evolución en detrimento del medio ambiente, que asegura la vida de todos los seres vivos. Se trata de una compleja situación donde se clama por una solución plausible, en que la evolución del progreso tecnológico no olvide de la necesidad de protegerse el medio ambiente. El tema envuelve también la eficacia horizontal de los derechos fundamentales, pues se refiere a las relaciones que envuelven tecnología y medio ambiente firmadas entre particulares. Hay que ponderar entre el progreso de la tecnología y la preservación ambiental, en la búsqueda por un desarrollo sostenible, de forma a atender a ambas necesidades humanas, sin comprometer los derechos fundamentales y la dignidad humana, imprescindibles a la sobrevivencia del individuo.O texto tem por objetivo refletir acerca do embate entre o progresso tecnológico e a preocupação com a crescente degradação ambiental. Nota-se que estas são questões de cujo tratamento tanto o Estado como a sociedade pós-moderna não podem se omitir. O progresso econômico da sociedade também depende do desenvolvimento tecnológico. Contudo, não se pode admitir sua evolução em detrimento do meio ambiente, que assegura a vida de todos os seres vivos. Trata-se de uma complexa situação onde se clama por uma solução plausível, em que a sociedade possa continuar a evoluir do progresso tecnológico sem olvidar do devido respeito e necessidade de se proteger o meio ambiente. O tema envolve também a eficácia horizontal dos direitos fundamentais, pois diz respeito às relações que envolvem a tecnologia e o meio ambiente firmadas entre particulares.
