Resumo: In order to analyze the fragility of copyright within the context of the digital world, presenting a solution through smart contract technology. This article analyzes the possibility of the use of blockchain technology as copyright protection mechanisms of these rights, in addition to studying the fragility of copyright in the digital world, which was taken over by a copy culture perpetrated by the users themselves. From this perspective, smart contracts show themselves as an possible solution to the problems of unauthorized copying and distribution of digital assets. However they still have obstacles to overcome so that they can be used for the purpose of copyright protection. For the elaboration of this article, qualitative research was used, focusing on the deductive method, which is demonstrated in the bibliographic review of scientific articles and the study of Brazilian legislation.

Además, estudia la fragilidad de los derechos de autor en el mundo digital, tomado por una cultura de la copia por parte de los propios usuarios. De esta forma, la tecnología estudiada aparece como una posible solución a los problemas de copia y distribución no autorizada de activos digitales en internet. Sin embargo, cabe señalar que existen obstáculos que superar para que esta tecnología pueda ser utilizada de una forma verdaderamente eficiente. Para la elaboración de este artículo, se utilizó la investigación cualitativa, con foco en el método deductivo, que se demuestra en la revisión bibliográfica de artículos científicos y el estudio de la legislación brasileña.Com o objetivo de analisar a fragilidade dos direitos autorais dentro do contexto do mundo digital, o presente artigo explora a possibilidade do uso da tecnologia dos smart contracts e blockchain como mecanismos de proteção desses direitos, e, dentro disso, explica o conceito dos smart contracts e seu funcionamento por meio da rede blockchain. Além disso, estuda a fragilidade dos direitos autorais no mundo digital, o qual foi tomado por uma cultura de cópia pelos próprios usuários. Dessa forma, a tecnologia estudada se mostra como possível solução para os problemas de cópia e distribuição não autorizada dos ativos digitais na internet. Todavia, ressalta-se que existem obstáculos a ultrapassar para que essa tecnologia possa ser utilizada de maneira verdadeiramente eficiente.
