Stare Decisis and the Effectiveness of the Juridical Process

Resumo: The guarantee of judicial effectiveness is a basic right contemplated in Article 5, paragraph XXXV of the Brazilian Constitution. Constitutional Amendment 45 makes explicit the essential importance of fastness in judicial processes. Fastness and effectiveness are constitutionally basic rights. So that fastness in judicial processes could be achieved, the legal system has been endowed by a mechanism which entails legal holdings of the Supreme Federal Court with binding precedence. The stare decisis becomes a technique to guarantee the basic rights mentioned in Article 5, paragraphs XXXV and LXXVIII of the Constitution with the aim at improving judicial assistance.

A partir de la alteración constitucional promocionada por la enmienda 45, lo que antes era extrínseco ahora se vuelve expreso: la celeridad. Así, la celeridad y la efectividad se han vuelto en Derechos Fundamentales consagrados institucionalmente. En el intento de asegurar la celeridad, el constituyente Derivado dotó el sistema jurídico del mecanismo de vinculación de las decisiones judiciales proferidas por el Supremo Tribunal Federal. La súmula vinculante se ha convertido, entonces, en técnica garantizadora de los derechos fundamentales consagrados por los incisos XXXV y LXXVIII del art. 5º de la Constitución, objetivando mejorar la prestación jurisdiccional.A garantia de efetividade do processo constitui-se Direito Fundamental consagrado pelo artigo 5º, inciso XXXV da Constituição da República. Com a alteração constitucional promovida pela Emenda 45, o que antes era intrínseco agora é expresso: a celeridade. Assim, celeridade e efetividade passaram a constituir Direitos Fundamentais consagrados constitucionalmente. Para tentar assegurar a celeridade, o Constituinte Derivado dotou o sistema jurídico do mecanismo de vinculação das decisões judiciais proferidas pelo Supremo Tribunal Federal.
