Home education and the issue of school sociability: reflections on Bill 2.401/2019

Resumo: This article intends to propose reflections on the recent discussions around the fundamental right to education and homeschooling, which has been proposed through the law 2.401 /2019. For this, we will make a brief discussion about the role of the school today and its importance in the socialization of young people, bringing arguments present in the Common National Curricular Base (BNCC), National Basic Education Guidelines and arguments related to the jurisprudential issue in the country's Supreme Court. Then, we will analyze the positions adopted in relation to the homeschooling proposal, highlighting the issue of constitutionality and the adversities that are part of the specific Brazilian case. Finally, we will highlight the relevance of the school's role as a place of sociability, where the child or adolescent can experience a democratic, citizenship and effectively open to diversity.

Para esto, haremos una breve discusión sobre el papel de la escuela hoy y su importancia en la socialización de los jóvenes, presentando argumentos presentes en la Base Curricular Común Nacional (BNCC), Pautas Nacionales para la Educación Básica y argumentos relacionados con la cuestión jurisprudencial en la Corte Suprema del país. . Luego, analizaremos las posiciones adoptadas en relación con la propuesta de educación en el hogar, destacando el tema de la constitucionalidad y las adversidades que son parte del caso brasileño específico. Finalmente, destacaremos la relevancia del papel de la escuela como lugar de sociabilidad, donde el niño o adolescente puede experimentar una ciudadanía democrática, y efectivamente abierta a la diversidad.Esse artigo propõe reflexões sobre as recentes discussões em torno do direito fundamental à educação e da educação domiciliar, que tem sido proposta através do Projeto de Lei nº 2.401/2019. Para isso, faremos uma breve discussão sobre o papel da escola na atualidade e sua importância na socialização dos jovens, trazendo argumentos presentes na Base Nacional Comum Curricular (BNCC), Diretrizes Nacionais da Educação Básica e argumentos relacionados à questão jurisprudencial na Suprema Corte do país. Em seguida, faremos uma análise sobre os posicionamentos adotados em relação à proposta do ensino domiciliar, destacando a questão da constitucionalidade e das adversidades que fazem parte do caso específico brasileiro. Por fim, evidenciaremos a relevância do papel da escola como local de sociabilidade, onde a criança ou o adolescente pode experienciar uma vivência democrática, cidadã e efetivamente aberta à diversidade.
