The unborn child and the beginning of life

Resumo: | “The person’s civil personality starts with the living birth, but the law provides for the rights of the unborn child since its conception”. That is what provides article 2o of the Brazilian Civil Code. Such provision, object of several juridical discussions and opinions, due to its ambiguity, leads us to some questionings that go beyond mere juridical positions, also reaching the fields of science, faith and philosophy. Our juridical ordaining protect the unborn child’s rights; but what is the definition of “unborn child”? What is conception? From what moment is there conception? When does life begin? These questions easily comes to mind when we try to analyze the ights of the unborn child, its personality and the other questions related, which in this paper will be analyzed through the investigation of the fatherland doctrine by the use of a logical deductive research method. |

Es lo que dispone el artículo 2º del Código Civil Brasileño. Tal dispositivo, objeto de diversas discusiones y oponiones jurídicas, en virtud de su ambigüedad, nos lleva a algunos cuestionamientos que van además de posicionamientos meramente jurídicos, abrange también los campos de la ciencia, de la fe y de la filosofía. Nuestro ordenamiento jurídico proteje los derechos del nacituro; pero ¿cuál es la definición de nacituro? ¿A partir de qué momento ocurre la concepción? ¿Cuándo se inicia la vida? Estos cuestionamientos fácilmente nos viene a la mente cuando buscamos analisar los derechos del nacituro, su personalidad y demás cuestiones ligadas a él, que en este artículo se busca analisar mediante investigación, la doctrina pátria, en el cual se utiliza el método de investigación lógico-deductivo.“A personalidade civil da pessoa começa com o nascimento com vida, mas a lei põe a salvo desde a concepção os direitos do nascituro”. É o que dispõe o artigo 2º do Código Civil Brasileiro. Tal dispositivo, objeto de diversas discussões e opiniões jurídicas, em virtude de sua ambigüidade, leva-nos a alguns questionamentos que vão além de posicionamentos meramente jurídicos, atingIndo também os campos da ciência, da fé e da filosofia. Nosso ordenamento jurídico protege os direitos do nascituro; mas qual é a definição de nascituro? O que é concepção? A partir de que momento há a concepção? Quando se inicia a vida?
