Resumo: A hypothesis on the overjustification effect is provided, or rather, the decrease or suppression of the intrinsic motivation to concretize certain activities caused by external stimuli, such as rewards or punishments. The first part of the article will compare the hypothesis with similar ones taken from behavioral economy. Its common and relevant clue for Law is the introduction of doubts on the dissuasion impact of legal sanctions. The second part will examine in details the implication of the overjustification effect within the context of contract law.

The second part will examine in details the implication of the overjustification effect within the context of contract law.El presente texto trata de la hipótesis del efecto de superjustificación (overjustification effect), la reducción o supresión de la motivación intrínseca para realizar determinada actividad provocada por estímulos externos, como recompensas y castigos. En un primer momento, se compara esa hipótesis con otras afines, provenientes de la economía comportamental, cuyo rasgo común y relevante para el derecho es el de suscitar dudas sobre el impacto disuasorio de sanciones legales. En un segundo momento, el artículo examina de forma más minuciosa las implicaciones del efecto de superjustificación para el área del derecho contractual.O presente texto trata da hipótese do efeito de superjustificação (overjustification effect), a redução ou supressão da motivação intrínseca para realizar certa atividade provocada por estímulos externos, como recompensas ou castigos. Na primeira parte, compara-se essa hipótese com outras, afins, provenientes da Economia comportamental, cujo traço comum e relevante para o Direito é o de levantar dúvida sobre o impacto dissuasório de sanções legais.
