The 1988 Brazilian Constitution and the Right to Schooling

Resumo: Schooling is a fundamental right and integrates the existential minimum of the whole human being. The 1988 Brazilian Constitution placed schooling and education within the social rights as integral factors to basic rights. The National Constitution Assembly sought to elaborate a text which would have normative efficaciousness and placed the access to obligatory and free schooling as a subjective public right. Although during the sessions struggles between the liberal and socialist ideologies were rife, a compromise was achieved with deep changes in the text. These may be considered progressive for the implementation of more democratic, free, just and pluralistic education with the development of the entire society as its corollary.

La Constitución Federal de 1998 puso la educación entre los derechos sociales, haciendo parte de los derechos fundamentales. La Asamblea Nacional Constituyente de 1988 se ha esforzado para elaborar un texto que tuviera la eficacia normativa, eligiendo, incluso, el acceso a la enseñanza obligatoria y gratuita como derecho público subjetivo. En la elaboración de la Carta de 1988 hubo un embate entre bandas ideológicas liberales y socialistas, ocurriendo al fin una acomodación, trayendo grandes cambios en el texto constitucional, que pueden ser considerados avances para el logro e implementación de una educación más democrática, libre, justa y plural, teniendo como corolario el desarrollo de la sociedad como un todo.A educação é considerada direito fundamental e integra o mínimo existencial do homem integral. A Constituição Federal de 1988 enquadrou a educação dentre os direitos sociais, fazendo parte dos direitos fundamentais. A Assembleia Nacional Constituinte de 1988 se esforçou para elaborar um texto que tivesse eficácia normativa, elegendo, inclusive, o acesso ao ensino obrigatório e gratuito como direito público subjetivo.
