THE IMPORTANCE OF UNDERSTANDING THE HUMAN BEING TO FOREGROUND THE PRINCIPLE OF THE DIGNITY OF THE HUMAN PERSON

Resumo: The evolution of the concept of the human person over time is undertaken and the direct relationship of the concept with the principle of human dignity is demonstrated. So that the principle may be materialized and operational, without leaving it without contents due to its complexity, an in-depth analysis on what is the human being should be undertaken. The answer will envision the principle of the dignity of the human person as a tangible thing. It does not allow an empty discourse which merely underscores its importance but fails to employ it to give a response required by a concrete situation. The importance of attributing an ontological charge to the human person and analyzing it in its relationships should be underscored. Since the principle of human dignity should protect human intrinsic characteristics, without which there is no human person, listing them within a concept of the human makes more comprehensive the conceptualization of the principle. Consequently, the application to cases within the ambit of the judiciary will be improved.

Consequently, the application to cases within the ambit of the judiciary will be improved.El objetivo de este texto es hacer un abordaje de la evolución del concepto de hombre ocurrido con el paso del tiempo y demostrar la relación directa de ese concepto con el principio de la dignidad humana. En este contexto, se verifica que para concretizar y operar el referido principio sin que se acabe por dejarlo sin contenido, debido a su complejidad, es necesario realizar un análisis profundo a respecto de lo que es el hombre. Partiendo de esa respuesta es posible percibir el principio de la dignidad de la persona humana como algo tangible, no permitiendo que se incurra en un discurso vacío, que solo pregona la importancia de él, pero no logra utilizarlo para dar la respuesta que la situación concreta exige. De esta manera, se constata la importancia de atribuir una carga ontológica al hombre, bien como analizarlo en su aspecto relacional. Así, considerando que el principio de la dignidad humana debe proteger aquellas características intrínsecas del hombre, sin las cuales deja de ser persona, inscribirlas en un concepto de lo que sea el hombre vuelve más comprensible la conceptualización del referido principio y, consecuentemente, mejora su aplicación en los casos que se presenten al Poder judiciario.O objetivo deste texto é fazer uma abordagem da evolução do conceito do homem ocorrido com o passar do tempo e demonstrar a relação direta desse conceito com o princípio da dignidade humana. Nesse contexto, verifica-se que para concretizar e operacionalizar o referido princípio, sem que se acabe por deixá-lo sem conteúdo, devido a sua complexidade, é preciso realizar uma análise profunda a respeito do que é o homem. Partindo dessa resposta se torna possível vislumbrar o princípio da dignidade da pessoa humana como algo tangível, não permitindo que se incorra em um discurso vazio, que apenas prega a importância dele, mas não consegue utilizá-lo para dar a resposta que uma situação concreta exige. Desse modo, constata-se a importância de atribuir uma carga ontológica ao homem, bem como analisá-lo em seu aspecto relacional.
