Environmental Law as an Integrating Factor of the Existential Minimum Contents to Guarantee the Other Rights of the Personality

Resumo: The contents of the existential minimum are related to the fundamental right to an ecologically balanced environment, according to Article 225 of the Brazilian Federal Constitution. An analysis of the concept of environment and its fundamentality is provided and the fundamental (social) rights that are part of the classical contents of the existential minimum nucleus are given. The authors would like to contribute towards the inclusion of fundamental law to a balanced environment within the concept of the existential minimum due to its indispensability for the dignity of the person, which is the basis and guiding principle of the Brazilian republic. All the rights of the person depend intrinsically on a healthy environment proper to human life.

Para ello, propone un análisis del concepto de medioambiente y de su fundamentación, bien como presenta los derechos (sociales) fundamentales que hacen parte del contenido (clásico) del núcleo existencial. Sin embargo, lo que se busca es contribuir para la inclusión del derecho fundamental al medioambiente equilibrado en el concepto del mínimo existencial, llevando en consideración su carácter imprescindible para la dignidad de la persona humana, que es fundamento y principio regulador de la republica. Por fin, se concluye que los derechos de personalidad dependen, intrínsecamente, de un medioambiente sano y adecuado a la vida humana.O presente artigo visa relacionar o conteúdo do mínimo existencial com o direito fundamental ao meio ambiente ecologicamente equilibrado, contido no artigo 225, caput, da Constituição Federal. Para tanto, propõe uma análise do conceito de meio ambiente e de sua fundamentalidade, bem como apresenta os direitos (sociais) fundamentais que fazem parte do conteúdo (clássico) do núcleo do mínimo existencial. Entretanto, o que aqui se pretende é contribuir para a inclusão do direito fundamental ao meio ambiente equilibrado no conceito do mínimo existencial, tendo em vista sua imprescindibilidade para a dignidade da pessoa humana, que é fundamento e princípio norteador da nossa República.
