Resumo: The theme embraces many controversies in the Brazilian and foreign doctrine and jurisprudence. From this premise, we aim at analyzing the rights of the investigated in relation to establishing proof by the DNA genetic examination, in face of the limitations presented with the issuing of the STJ summary no 301, considering the different principles, its relativism and application in the examination of rights of the parts in the investigation of paternity, as well as the importance of proof concerning the anticipation of the effects of guardianship and the provisions of preventive nature, attempting to demonstrating its relevance, aiming at realizing the child’ material rights not yet recognized.

A partir de esa premisa, se objetiva evaluar el derecho del investigante a la realización de la prueba a través del análisis genético del DNA, ante las limitaciones presentadas con la edición de la Súmula n. 301, del STJ, considerando los diversos princípios, su relativización y aplicación en la evaluación del derecho de de las partes en la investigación de paternidad, así como la importancia de la prueba en lo que se refiere a la anticipación de los efectos de la tutela y de las providencias de naturaleza cautelar, se busca demostrar su cabida, con vistas a la realización del derecho material del hijo todavia no reconocido.O tema abrange muitas controvérsias na doutrina e na jurisprudência brasileiras e estrangeiras.
