The article starts from the assumption that the principle of human dignity is the axiological vector of the Constitution and that the catalog of fundamental rights is materially open, especially to the rights derived from the International Covenant on Economic, Social, and Cultural Rights, whose effectiveness must be guaranteed. It aims to address the problem of determining the content of fundamental social rights as one of the obstacles to their judicialization and to evaluate the delimitation of the existential minimum and the prohibition of regressivity in economic, social, and cultural rights as alternatives to establish a minimum content of these rights. The method is hypothetical-deductive and, in conclusion, points out as possible parameters for the justiciability of fundamental social rights the minimum levels assured in law, based on the existential minimum and the prohibition of retrogression.
