JUDICAL DISCRITIONARITY BY WILFRED WALUCHOW´S INCLUSIVE JURIDICAL POSITIVISM VERSUS THE DWORKINIAN IDEA

Resumo: Judicial discritionarity is analyzed from the point of view of Ronald Dworkin, who denies its existence, even in difficult cases. On the other hand, the essay forwards the renewed positivism by Wilfrid Waluchow, who insists on its existence and necessity for difficult cases. Current investigation analyzes the definition on the meanings of discritionarity of the law philosopher and its use by authors, coupled to the enhancement of theoretical reformulations of inclusive positivism and the failures of interpretative theory, especially with regard to judge Hercules and the existence of a single correct answer.

Como contrapunteo, el trabajo presenta la visión del positivismo renovado de Wilfrid Waluchow, que reafirma su existencia y deseabilidad en casos complejos. La investigación se propone aún analizar la definición sobre los estudios discrecionales atribuidos por la filosofía del derecho y su uso por los referidos autores y presentar reformulaciones teóricas del positivismo inclusivo y las fallas de la teoría interpretativa, especialmente en relación al juez Hércules y a la existencia de una respuesta correcta única.O presente artigo tem por objetivo analisar a discricionariedade judicial a partir da teoria de Ronald Dworkin, que nega a existência daquela, mesmo diante de casos difíceis. Como contraponto, o trabalho apresenta a visão do positivismo renovado de Wilfrid Waluchow, que reafirma a existência e desejabilidade dessa discricionariedade nos casos complexos.
