Minorities and the Search for Acknowledgement in the Democratic State: An Approach from the Principles by Jurgen Habermas and Nancy Fraser

Resumo: The theoretical aspects from the point of view of the theories by Habermas and Fraser are discussed to provide solutions for the acknowledgement and protection of the rights of minority populations. Analysis highlights the concept of minority through quantitative and qualitative criteria. The theoretical aspects proposed by Habermas are discussed to give voice to people through democratic procedures and the discourse theory legitimating law and administration authority. Current paper also verifies the theory of tri-dimension justice and the concept of subaltern counterpublics by Fraser, with critique to Habermas´s theory and defending the need for the acknowledgement and redistribution, also on the political plane, for minorities to have a participating equality in public life. What are the reaches of Habermas´s and Fraser´s theories for the acknowledgement and protect of minority groups? Which theory is most efficient with regard to minority rights? The theoretical aspects of Habermas´s and Fraser´s doctrines are exploited to verify which theory may bring better perspectives for the acknowledgement and protection of minority rights. Current bibliographical and documental research is foregrounded on the hypothetical, deductive, qualitative method and technique.

Current bibliographical and documental research is foregrounded on the hypothetical, deductive, qualitative method and technique.El presente estudio posee el objetivo general de explorar los aspectos teóricos a la luz de las teorías de Habermas y Fraser, a fin de verificar soluciones para el reconocimiento y protección de los derechos de las minorías. Así, en un primer momento, el estudio resalta el concepto de minoría, por intermedio del estudio de los criterios cuantitativo y cualitativo. En seguida, se abordar los aspectos teóricos propuestos por Jürgen Habermas, en lo cual tenta posibilitar voz a los individuos por intermedio do procedimiento democrático y de la teoría del discurso, siendo legitimador del Derecho y del poder administrativo. Por fin, el estudio verifica la teoría de la justicia tridimensional y el concepto de contra públicos subalternos construidos por Nancy Fraser, presentando críticas a la teoría de Habermas, defendiendo la necesidad de reconocimiento y redistribución, también en el plan de la política, para las minorías, a fin de poseer paridad participativa en la vida pública. El problema se coloca de la siguiente forma: ¿Cuál el alcance de las teorías de Habermas y Fraser para el reconocimiento y protección de los grupos minoritarios? ¿Cuál de estas teorías se muestra más eficiente en lo que atañe al derecho de minorías? La idea, entonces, es explorar los aspectos teóricos de los enseñamientos de Habermas y Fraser, a fin de verificar cual teoría puede trazar mejores perspectivas para el reconocimiento y protección de los derechos de las minorías. La investigación se estructura por el método hipotético-deductivo, abordaje cualitativo y la técnica de investigación es de pesquisa bibliográfico-documental.O objetivo geral do presente trabalho é explorar os aspectos teóricos à luz das teorias de Habermas e Fraser, a fim de verificar soluções para o reconhecimento e proteção dos direitos das minorias. Assim, num primeiro momento, o trabalho ressalta o conceito de minoria, pelo estudo dos critérios quantitativo e qualitativo. Em seguida, abordar-se-ão os aspectos teóricos propostos por Jürgen Habermas, no qual tenta possibilitar voz aos indivíduos por meio do procedimento democrático e da teoria do discurso, sendo legitimador do direito e do poder administrativo. Por fim, o trabalho verifica a teoria da justiça tridimensional e o conceito de contrapúblicos subalternos construídos por Nancy Fraser, apresentando críticas à teoria de Habermas, defendendo a necessidade de reconhecimento e redistribuição, também no plano da política, para as minorias, a fim de possuírem paridade participativa na vida pública. O problema coloca-se da seguinte forma: Qual o alcance das teorias de Habermas e Fraser para o reconhecimento e proteção dos grupos minoritários? Qual destas teorias se mostra mais eficiente no que tange ao direito de minorias? A ideia, então, é explorar os aspectos teóricos dos ensinamentos de Habermas e Fraser, a fim de verificar qual teoria pode traçar melhores perspectivas para o reconhecimento e proteção dos direitos das minorias.
