PUBLICATION OF PUBLIC ACTS AS A GUARANTEE OF THE DEMOCRATIC STATE: THE INFLUENCE OF NORBERTO BOBBIO ON THE DECISION OF THE BRAZILIAN SUPREME COURT

Resumo: References to the writings of Norberto Bobbio in the decisions of the ministers of the Brazilian Supreme Court triggered questions on the influence of the Italian author on their decisions. Since several themes emerged from current research, focus has been placed on the analysis of decisions on the publication of public acts. Bobbio´s influence may be evidence by his concept of democracy as ‘the government of visible authority’, controlled by the people, based on general, true, constant and non-retroactive norms. The above items denote the influence of the concepts of the Italian author on the construction and maintenance of democracy and democratic power through the Courts in a country immersed in a deep political crisis. Results deal with juridical positivism and Bobbio´s doctrine, coupled to his concept of the democratic state.

Considerando la pluralidad de temas dónde emerge la investigación, se optó por el análisis de los votos que envuelven procesos sobre publicidad de actos públicos. Entre las influencias de Bobbio sobre los votos de los ministro del Supremo Tribunal Federal, se puede evidenciar la concepción democrática como el ‘gobierno de poder visible’, controlado por el pueblo, pautado en normas generales, correctas, constantes y retroactivas. Los elementos señalados denotan la influencia de las concepciones del autor italiano en la construcción y mantenimiento de la democracia y del poder democrático, por medio del Poder judiciario, en un país inmerso en una fuerte crisis política. Buscando mejor exponer los resultados de la investigación, primeramente, se presenta el positivismo jurídico y la doctrina de Bobbio, bien como su concepción de Estado Democrático.As referências aos escritos de Norberto Bobbio, nos votos dos ministros do Supremo Tribunal Federal, fomentaram o questionamento do âmbito de influência do autor italiano nas decisões da casa. Considerando a pluralidade de temas que emergiu da pesquisa, optou-se pela análise dos votos envolvendo processos sobre publicidade de atos públicos. Dentre as influências de Bobbio sobre os votos dos ministros do Supremo Tribunal Federal, pode-se evidenciar a concepção da democracia como o ‘governo do poder visível’, controlado pelo povo, pautado em normas gerais, certas, constantes e irretroativas. Os elementos elencados denotam a influência das concepções do autor italiano na construção e manutenção da democracia e do poder democrático, por meio do Poder Judiciário, em um país imerso em uma forte crise política.
