HUMAN DIGNITY AND THE SOCIAL FUNDAMENTAL RIGHTS EFFECTIVENESS

Resumo: | This essay fits into the strict sense postgraduate program - Master of Law (LLM) – In the concentration area of the constitutional rights, written as a result of the research conducted by the research group on social rights in the University of the West of Santa Catarina (UNOESC), conducted by the first co-author, with the assistance of the two other co-authors. The principle of human dignity has been included in the list of the foundations of the Federative Republic of Brazil by the Constitution of 1988 which first article, opening the formal text, Treats the gradual evolution of the concept, over the years. The research is still object of a guiding principle of the rule of law, however, still irrigated of the most diverse disputes among philosophers, anthropologists and jurists subject to different interpretations approaches, and therefore also different application and effectiveness. In this regard, in order to provide better living conditions to the population, civilians fundamental rights, and most particularly, social rights are protected by the principle of human dignity, undergo continuing debate about its effectiveness. The obstacles to the effective result in the field of regulations is the necessary interpretative activity; the superficial constitutional content of the recipients of social rights and resistance of the constituted powers, first by omitting, then to resist the judiciary role in ensuring public policy. Finally it has to be the higher courts, especially the Supreme Court and the Supreme Court consolidated the use of human dignity as a justification argument of concessive decisions of social rights. |

Finally it has to be the higher courts, especially the Supreme Court and the Supreme Court consolidated the use of human dignity as a justification argument of concessive decisions of social rights.Este trabajo hace parte del Programa de Postgrado strictu sensu – Maestría en Derecho, en el área de derechos fundamentales, en el contexto de la producción del Grupo de Investigación en derechos sociales, de la Universidad do Oeste de Santa Catarina (UNOESC), conducido por el primer coautor, con la colaboración de los demás coautores. El principio de la dignidad humana fue incluido los fundamentos de la República Federativa de Brasil en la Constitución de 1988, ya en el primer artículo, abriendo el texto formal. La evolución paulatina del concepto, a lo largo del tiempo todavía es objeto de esa investigación que se vuelve hacia al concepto y su aplicabilidad como principio regente del Estado de Derecho, tema, por lo tanto, aún, lleno de las más distintas controversias entre los filósofos, antropólogos y juristas, sujeto a distintos abordajes interpretativos y, por ello, también distintas aplicaciones y efectuaciones. En este caso, con el objetivo de fornecer mejores condiciones de vida a la población, los derechos fundamentales civiles y principalmente los derechos sociales abrigados en el principio de la dignidad humana, se someten al debate continuo sobre su efectuación. Los problemas enfrentados en relación a la efectuación están ubicados en el campo dela normatividad y de la necesaria actividad interpretativa; el bajo nivel de profundidad constitucional de los destinatarios de los derechos sociales y de la resistencia de los Poderes constituidos, primero al omitirse, después al resistir a la actuación del Judiciario en garantizar políticas públicas. Por fin, se percibe que os los tribunales superiores, especialmente, el STF y el STJ consolidaron el empleo de la dignidad humana como argumento de justificación de las decisiones concesivas de derechos sociales.O presente trabalho se insere no Programa de pós-graduação stricto sensu – Mestrado em Direito, na área de concentração de direitos fundamentais, no contexto da produção do Grupo de pesquisa em direitos sociais, da Universidade do Oeste de Santa Catarina (UNOESC), sob a condução do primeiro coautor, com a colaboração dos demais coautores. O princípio da dignidade humana foi incluído no rol dos fundamentos da República Federativa do Brasil pela Constituição Federal de 1988, logo no primeiro artigo, abrindo o texto formal. A evolução paulatina do conceito, ao longo dos tempos ainda é objeto dessa pesquisa e volta-se ao conceito e sua aplicação como princípio norteador do Estado de Direito, tema, portanto, ainda, irrigado de controvérsias as mais diversas entre filósofos, antropólogos e juristas, sujeito às distintas abordagens interpretativas, e, por conseguinte, também distintas aplicação e efetivação. Nesse particular, com o objetivo de fornecer melhores condições de vida à população, os direitos fundamentais civis e principalmente os direitos sociais amparados pelo principio da dignidade humana, se submetem a debate contínuo acerca de sua efetividade. Os óbices à efetivação se situam no campo da normatividade e da necessária atividade interpretativa; do baixo teor de aprofundamento constitucional dos destinatários dos direitos sociais e da resistência dos Poderes constituídos, primeiro ao se omitirem, depois ao resistirem à atuação do Judiciário em garantir políticas públicas.
