Resumo: The debates on the relationship between Neurosciences and Criminal Law may seem very current and novel, however, it could well be argued that the origins are long-standing. There has always been the debate between “determinism vs. indeterminism ”, that idea that the world is predetermined - that everything has a cause and can be explained according to natural laws or not. This traditional debate could be carried over to today. However, it will no longer be such a philosophical or cosmological debate, but it will be a more objective debate listed behind empirical methods, based on experience and on the concrete observation of certain facts. Specifically, it will be a debate that will have to do with the specific data that the neurosciences provide us, and to what extent this influences - or could influence - current Criminal Law, at the same time that it will rethink in what way the incorporation of the Data provided by other sciences and disciplines condition - or could condition - to maintain the Criminal Law that we have today.- In this way, what affects the debate is the maintenance or not, of a Criminal Law of Guilt by In fact, that is to say that the debate will focus on the material basis of guilt, on the idea that human beings are guilty only insofar as they act freely.

Siempre ha existido el debate entre “determinismo vs. indeterminismo”, esa idea de que el mundo está predeterminado -de que todo tiene una causa y se puede explicar conforme leyes naturales o no. Este debate tradicional, podría trasladarse a la actualidad. Sin embargo, ya no se tratará de un debate tan filosófico ni cosmológico, sino que se tratará de un debate más objetivo enlistado tras métodos empíricos, basados en la experiencia y en la observación concreta de determinados hechos. Concretamente, se tratará de un debate que tendrá que ver con los datos concretos que nos aportan las neurociencias, y en qué medida ello influye – o podría influir- en el Derecho Penal actual, a la vez que replanteará de qué manera la incorporación de los datos aportados por otras ciencias y disciplinas condicionan – o podrían condicionar- para mantener el Derecho Penal que tenemos hoy en día. De esta manera, a lo que afecta el debate es al mantenimiento o no, de un Derecho Penal de la Culpabilidad por el hecho, es decir que el debate versará sobre el fundamento material de la culpabilidad, sobre la idea de que el ser humano solo es culpable en la medida en que actúa libremente. Os debates sobre a relação entre Neurociências e Direito Penal podem parecer muito atuais e inéditos, no entanto, pode-se argumentar que as origens são antigas. Sempre houve o debate entre “determinismo vs. indeterminismo ”, aquela ideia de que o mundo é predeterminado - de que tudo tem uma causa e pode ser explicado de acordo com leis naturais ou não. Este debate tradicional poderia ser transportado para hoje. No entanto, não será mais um debate filosófico ou cosmológico, mas será um debate mais objetivo listado atrás dos métodos empíricos, baseado na experiência e na observação concreta de certos fatos. Especificamente, será um debate que terá a ver com os dados específicos que as neurociências nos fornecem, e em que medida isso influencia - ou poderá influenciar - o Direito Penal vigente, ao mesmo tempo que vai repensar de que forma a incorporação dos Dados fornecidos por outras ciências e disciplinas condicionam - ou poderiam condicionar - a manutenção do Direito Penal que temos hoje.- Desta forma, o que afeta o debate é a manutenção ou não, de um Direito Penal da Culpa por De fato, ou seja, o debate se concentrará na base material da culpa, na ideia de que os seres humanos são culpados apenas na medida em que agem livremente.
