Resumo: The present study aims to bring some reflections on the role of the corporate citizen faithful to the law, as synonymous with a company that has an effective compliance program, in terms of possible violations of human rights as a result of climate change. To do so, it discusses climate change and human rights. In this first stage, the focus is on the interrelationship between the aforementioned themes, insofar as the first can directly affect the second. Then, in the expanded study, when the company is listed as an important agenda promoting climate change, some soft law instruments that regulate the subject matter of study are listed, mainly the United Nations Guiding Principles on Business and Human Rights 2011. Finally, it reflects on how the corporate citizen faithful to the law can be a partner of human rights in the context of climate change.

Para ello, aborda el cambio climático y los derechos humanos. En esta primera etapa, el foco está puesto en la interrelación entre los temas mencionados, en la medida en que el primero puede afectar directamente al segundo. Luego, en el estudio ampliado, cuando se cataloga a la empresa como importante promotora del cambio climático, se enumeran algunos instrumentos de soft law que regulan la materia en estudio, principalmente los Principios Rectores de las Naciones Unidas sobre Empresas y Derechos Humanos 2011. Finalmente, se refleja sobre cómo el ciudadano corporativo fiel a lo derecho puede ser socio de los derechos humanos en el contexto del cambio climático.O presente estudo tem o objetivo de trazer algumas reflexões sobre o papel do cidadão corporativo fiel ao direito, enquanto sinônimo de empresa que possui programa de compliance efetivo, no plano das possíveis violações aos direitos humanos como consequência das mudanças climáticas. Para tanto, discorre-se sobre a mudança climática e os direitos humanos. Nessa primeira etapa o foco é na inter-relação entre os referidos temas, na medida em que a primeira pode afetar de forma direta o segundo. Em seguida, já no estudo ampliado, momento em que se elenca a empresa como um importante agente promotor da mudança climática, elencam-se alguns instrumentos de soft law que regulam a matéria objeto de estudo, principalmente os Princípios Orientadores das Nações Unidas sobre Empresas e Direitos Humanos de 2011.
