Resumo: The main items in Jürgen Habermas’s works are discussed so that the subsequent legitimating criteria are established through the theory of communicative action. The author’s ideas are compared to certain aspects involving Brazilian reality to evaluate whether these practices, especially the juridical ones, are proper to the notion of Habermas’s legitimation. A critical judgment will be assayed on the trend to where ethical relativization, inherent to discourse theory, may lead society. The interpretation for the avoidance of such distortions will also be discussed.

The interpretation for the avoidance of such distortions will also be discussed.Este trabajo ha abordado los principales elementos de la vasta obra de Jürgen Habermas, de modo que, a través de la teoría de la acción comunicativa, se han establecido los criterios de legitimidad decurrentes de ella. El objetivo es contraponer el pensamiento del autor frente a algunos aspectos de la realidad brasileña, a fin de evaluar si estas prácticas, especialmente la judicial, están adecuadas al precepto de legitimidad habermasiana. Al fin, se pretende hacer una evaluación crítica de los rumbos que la relatividad ética inherente a la teoría del discurso ético puede llevar a la sociedad, bien como la forma con que debe de ser interpretada a fin de evitar tales distorsiones.O presente trabalho buscou abortar os principais elementos da vasta obra de Jürgen Habermas, de modo a, através da teoria da ação comunicativa, serem estabelecidos os critérios de legitimação dela decorrentes. Pretende-se confrontar o pensamento do autor com alguns aspectos da realidade brasileira, de modo a avaliar se essas práticas, principalmente a judicial, adéquam-se ao preceito de legitimidade habermasiana.
