The struggle against cyber bullying as a fundamental right to the education of children and young people

Resumo: The evolution of technology has modified social behavior within the virtual environment. Bullying, characterized as violence, mainly produced in school, has been extended to cyberspace (the so-called cyberbullying). The illicit behavior causes harm, destabilizes school conviviality and impairs the right to education which is constitutionally guaranteed to children and young people. Current paper, employing the deductive method and bibliographical research, analyzes the need to combat cyberbullying and examines two juridical solutions: the right to compensation and the imposition of socio-educational measures. Children´s right to education requires an effective fight against cyberbullying offered by law.

Children´s right to education requires an effective fight against cyberbullying offered by law. Con la evolución de la tecnología, los comportamientos sociales también ocurren en el ambiente virtual. Es el caso del bullying, caracterizado por la violencia generada principalmente en el ámbito escolar, que pasa a tener su extensión en el ciberespacio: el cyberbullying. Esas condutas ilícitas generan consecuencias maléficas para las víctimas, desestabilizando el convivio escolar y perjudicando considerablemente el derecho a la educación constitucionalmente asegurado a los niños y a los adolescentes. Delante de ese escenario, en el presente estudio se tiene por objetivo analizar el cyberbullying como una conduta dañosa a la concretización del derecho fundamental a la educación. Utilizando el método deductivo e investigación bibliográfica, este estudio se desarrolla buscando demostrar la necesidad de combatirse el cyberbullying, examinando dos soluciones apuntadas por el sistema jurídico: el deber de indemnización y la imposición de medidas socioeducativas. Al final, se concluye que la concretización del derecho a la educación para niños y adolescentes demanda un efectivo combate a cyberbullying, valiéndose de las medidas ofrecidas por el ordenamiento jurídico.Com a evolução da tecnologia, os comportamentos sociais também ocorrem no ambiente virtual. É o caso do bullying, caracterizado pela violência gerada principalmente no âmbito escolar, que passa a ter sua extensão no ciberespaço: o cyberbullying. Essas condutas ilícitas geram consequências maléficas para as vítimas, desestabilizando o convívio escolar e prejudicando consideravelmente o direito à educação constitucionalmente assegurado às crianças e aos adolescentes. Diante desse cenário, o presente estudo tem por objetivo analisar o cyberbullying como uma conduta prejudicial à concretização do direito fundamental à educação. Utilizando o método dedutivo e pesquisa bibliográfica, este estudo desenvolve-se procurando demonstrar a necessidade de se combater o cyberbullying, examinando duas soluções apontadas pelo sistema jurídico: o dever de indenização e a imposição de medidas socioeducativas.
