Civil Responsibility and the Reparation of Environmental Damage: Limits and Guardianship Possibilities of Individual Rights

Resumo: No doubts exist on the right that the Law must be responsible for the natural environment since the latter’s preservation and equilibrium of the ecosystem are essential for the quality of human life and for the planet’s subsistence or, at least, for human subsistence, guaranteeing natural conditions indispensable for human survival. Civil responsibility is thus accountable for the protection of the environment, or in practical terms, that the polluter must be also the payer. The general theory of environmental damage produced by activities which are unfriendly to the environment states that civil responsibility for damage is objectively aggravated. This fact is based on the integral risk theory, or rather, the polluter is also accountable for all activities placed for the prevention and repairing of environmental damages. Civil responsibility is thus attributed to halt the degradation of the environment, assuring life as the most important thing from which several personal rights emanate.

Civil responsibility is thus attributed to halt the degradation of the environment, assuring life as the most important thing from which several personal rights emanate.Actualmente, no cabe dudas que el derecho debe tutelar el medio ambiente, pues se sabe que su preservación e equilibrio del ecosistema son esenciales, no solo para garantizar la calidad de vida humana, pero la propia existencia del planeta, o, por lo menos, de la especie humana, garantizando las condiciones naturales indispensables a su supervivencia. Desde esa perspectiva, se denota al instituto de la responsabilidad civil un papel preponderante y preferencial en la protección ambiental. Ella se constituye la traducción más fiel del principio del contaminador pagador. En la exposición de la teoría general del daño ambiental decurrente de la actividad que ofrece riesgo al medio se percibe que la responsabilidad civil por el daño es objetiva y sufre un agravio, fundamentada en la teoría del riesgo integral, en la que el agente contaminador responder por todos los riesgos de la actividad y todos los encargos que recurren de la prevención y reparación de los daños provocados. Delegando la responsabilidad civil a la posibilidad de cohibición de la degradación del medio, asegurando, así, el bien más grande que es la vida y del cual advienen innumerosos derechos de orden personalísima del ser humano.Atualmente não se paira dúvidas de que o direito deve, de forma eficaz, tutelar o meio ambiente, pois se sabe que a sua preservação e o equilíbrio ecossistemático são essenciais, não apenas para garantir a qualidade de vida humana, mas a própria subsistência do planeta, ou, pelo menos, da espécie humana, garantindo as condições naturais indispensáveis à sua sobrevivência. Neste diapasão, assinala-se, pois ao instituto da responsabilidade civil um papel preponderante e preferencial na proteção do ambiente. Ela constitui mesmo a tradução mais fiel do princípio do poluidor pagador. Na exposição da teoria geral do dano ambiental decorrente da atividade que oferecem risco ao meio denota-se que a responsabilidade civil pelo dano é objetiva agravada, com fundamento na teoria do risco integral, devendo o poluidor responder por todos os riscos da atividade e todos os encargos decorrentes da prevenção e reparação dos danos acaso provocados.
