Elder adoptation and senexion: alternatives to vulnerability when the result of abandonment

The placement of the elder in a surrogate family with the recognition of the socio-affective kinship bond, commonly called "adoption of the elder", is a growing and relevant theme, since it discusses a different option to the abandonment of the elder, a common practice in today's society. This, because the theme exposes the situation of abandonment, which increases vulnerability. Legal impediments to the adoption of the elder are clear as the national norms in force do not support it and the Judiciary maintains a negative position. Thus, the objective of this research is to discuss the bills n. 5532/19 and 105/20, which propose the placement of the elder in a substitute family, either by the adoption of the elder, or by the senexion, bringing to light their legal and juridical foundations, as well as the position of the judiciary on this issue. The methodology used is a qualitative approach, deductive method, and bibliographic and documental techniques. As a result, care, affection and dignity must be preserved in the phase of life in which the elder find themselves, and actions that infantilize them should not be encouraged. Therefore, it is necessary to have a specific regulation for this situation, as proposed in bill 105/20, as a more protective position of the Judiciary for such cases.
