Direct Economic Impacts Pertaining to Extrajudicial Activity from the Point of View of an Economic Analysis of Law

Resumo: Direct economic impacts pertaining to extrajudicial activity are analyzed from the point of view of the Economic Analysis of Law. After an introduction, the first section presents brief considerations on the private activities in notary offices even though delegation occurs by the public authority. The second section deals with the occurrence of Economic Analysis of Law within the context of extrajudicial notary offices with notes on Economic Analysis of Law that promotes an analysis of law science through the application of economics. The third section investigates direct economic impacts hailing from the constitutional, legal and normative system belonging to extrajudicial activities. Further, values represented by the activity and its mandatory overtures are also given, coupled to the economic impacts for notaries and registrars. Through economic analysis, ordering and application to the notary and registrar fields bring forth some direct economic impacts. Bibliographical investigation, especially books, journals, law texts and other publications on the issue, and the deduction method are employed.

En el presente artículo se trata sobre algunos impactos económicos directos atinentes a la actividad extrajudicial bajo la óptica del Análisis Económico del Derecho - AED. El estudio se desarrolla, tras su introducción, trayendo en el capítulo inicial breves consideraciones sobre el ejercicio privado de la actividad en las notarías, aunque la delegación suceda por parte del Poder Público. En el capítulo 2 (dos) se trata de la incidencia del Análisis Económico del Derecho en el campo de las actividades notarias extrajudiciales, con apuntamientos sobre el Análisis Económico del Derecho que promueve el análisis de la ciencia jurídica a través de la aplicación de la ciencia económica. El estudio avanza con el intuito de reflexionar en el capítulo 3 (tres) acerca de impactos económicos directos - advenidos del sistema constitucional, legal y normativo atinente a la actividad extrajudicial, ocasión en que discurre sobre algunos valores representados por la actividad y sus repases obligatorios, para después mencionar impactos económicos para los notarios y registradores, concluyendo, a través del análisis económico, que el ordenamiento vigente y aplicado al campo notarial y registral trae algunos impactos económicos directos. En el estudio se utiliza el método de investigación bibliográfico, conjugado con el método de abordaje deductivo, observando el dispuesto en libros, revistas, textos legales uy otras publicaciones sobre el tema. O presente artigo trata sobre alguns impactos econômicos diretos atinentes à atividade extrajudicial sob a ótica da Análise Econômica do Direito - AED. O trabalho desenvolve-se, após a sua introdução, trazendo no capítulo inicial breves considerações sobre o exercício privado da atividade nos cartórios, embora a delegação ocorra por parte do Poder Público. O capítulo 2 (dois) trata da incidência da Análise Econômica do Direito na seara dos cartórios extrajudiciais, com apontamentos sobre a Análise Econômica do Direito que promove a análise da ciência jurídica através da aplicação da ciência econômica. O estudo avança com o intuito de refletir no capítulo 3 (três) acerca de impactos econômicos diretos - advindos do sistema constitucional, legal e normativo atinente à atividade extrajudicial, ocasião em que discorre sobre alguns valores representados pela atividade e os seus repasses obrigatórios, para depois mencionar impactos econômicos para os notários e registradores, concluindo, através da análise econômica, que o ordenamento vigente e aplicado ao campo notarial e registral traz alguns impactos econômicos diretos. O trabalho utiliza o método de investigação bibliográfico, conjugado com o método de abordagem dedutivo, observando o disposto em livros, revistas, textos legais e outras publicações sobre o assunto.
