The myths of legal positivism

Resumo: | Legal positivism, as a set of theses necessarily defended or assumed by those that fly its colors, has being commonly criticized with bases in errors or myths, constituting a “straw man” of what this philosophical tradition is. In this paper, we proport to rescue the central theses of positivism, defining them by the artifact thesis and the separability thesis, with contingent presence of the source thesis and/or the conventionality thesis. With that settled, we go on to demonstrate that the idea of a “outdated” positivism, unable to account for legal principles, is false, as well as the picture of a legal positivism that implies some specific interpretative methodology, such as textualism or originalism. Through this article, we expect to clear or even recover the debate about legal positivism, specially in Brazil, reviving the theses that are really defended by this century-old philosophical tradition, distancing ourselves from the “straw man” created. |

El positivismo, como conjunto de tesis necesariamente defendidas o asumidas por todo aquel que porta sus colores, ha sido criticado a partir de errores y mitos, constituyendo un “espantapájaros” de lo que realmente sería esta tradición filosófica. En esta artículo nos propusimos rescatar las tesis centrales del positivismo, definiéndolo por la presencia de la tesis del artefacto y la tesis de la separabilidad, con la presencia contingente de la tesis de las fuentes y/o la tesis de la convencionalidad. Con esto en mente, nos propusimos demostrar que la idea de un positivismo “superado” que no sería capaz de explicar la presencia de principios jurídicos es falsa, como lo es la visión de que el positivismo implicaría alguna metodología interpretativa, como textualismo u originalidad. Con esto, esperamos esclarecer o incluso recuperar el debate sobre el positivismo, especialmente en Brasil, reviviendo las tesis realmente defendidas por esta tradición filosófica centenaria y alejándose del “espantapájaros” creado. O positivismo, como conjunto de teses necessariamente defendidas ou assumidas por todos que ostentem suas cores, tem sido criticado com base em erros e mitos, constituído um “espantalho” do que realmente seria esta tradição filosófica. Neste artigo, nos propusemos a resgatar as teses centrais do positivismo, definindo-o pela presença da tese do artefato e da tese da separabilidade, com presença contingente da tese das fontes e/ou da tese da convencionalidade. Com isso assentado, partimos para demonstrar que a ideia de um positivismo “superado” e que não seria capaz de explicar a presença de princípios jurídicos é falsa, bem como é falsa a visão de que o positivismo implicaria alguma metodologia interpretativa, tal como o textualismo ou o orignalismo.
