The Applicability of the Theory of the Obligations of Means and the Obligations of Result for Consent in Assisted Human Reproduction Techniques

Resumo: The obligation of means and obligations of results theory and its applicability is analyzed within the context of contracts by specialized clinics and hospitals for assisted human reproduction by any technique. Research was first undertaken on the contract employed in the establishment of juridical negotiation between assisted human reproduction clinics and their patients, namely people who are interested in artificial fecundation technique. The contract provides not only for the provision of medical services but also more specific documents to be employed in certain circumstances, namely, consent for techniques in assisted human reproduction, authorization for in vitro or artificial insemination fertilization with oocyte/semen donated or ceded free of charge, the cryopreservation of semen, and others. When the first specific document is analyzed in detail, the establishment of contracted obligation has been detected, in one of its topics, as an obligation of means and not of result. The viability of the above definition is questioned and an analysis of the theory of the obligation of means and the obligation of results is undertaken. It is thus inserted within the information on consent for assisted human reproduction techniques and related to the theory on civil responsibilities.

It is thus inserted within the information on consent for assisted human reproduction techniques and related to the theory on civil responsibilities.El presente artículo trata de la teoría de las obligaciones de medio y de resultado y su aplicabilidad en uno de los instrumentos contractuales utilizados por clínicas y hospitales especializados en la realización de reproducción humana asistida, en cualquiera de sus técnicas. Tras investigación realizada sobre el contracto utilizado en la formación de la relación jurídica de negociación entre las clínicas de reproducción humana y sus pacientes, o sea, las personas interesadas en someterse a alguna técnica de fecundación artificial, se ha observado que el uso no solo del contrato de prestación de servicios médicos, pero también de otras especies de documentos más específicos para determinadas situaciones, como el informe de consentimiento para técnicas de reproducción humana asistida, o instrumento de autorización para fertilización in vitro/inseminación artificial con ovocito/semen donado o cedido gratuitamente, o acuerdo de crio preservación de semen, entre otros. Analizando detalladamente el primer documento específico citado, se ha observado el establecimiento, en uno de sus temas, de la especie de obligación contractada, siendo obligación de medio y no de resultado. Se cuestiona, entonces, la viabilidad de esa definición, haciéndose un estudio sobre la teoría de las obligaciones de medio y de resultado, insiriéndola en el informe de consentimiento para las técnicas de reproducción humana asistida, haciendo una relación sobre las teorías de responsabilidad civil.O presente artigo aborda a problemática da teoria das obrigações de meio e de resultado e sua aplicabilidade em um dos instrumentos contratuais utilizados por clínicas e unidade de hospital especializadas na realização de reprodução humana assistida, em qualquer de suas técnicas. Após pesquisa realizada sobre o contrato utilizado na formação da relação jurídica negocial entre as clínicas de reprodução humana assistida e seus pacientes, ou seja, pessoas interessadas em se submeter a alguma técnica de fecundação artificial, observou-se o uso não apenas do contrato de prestação de serviços médicos, mas também de outras espécies de documentos mais específicos para determinadas situações, como o informe de consentimento para técnicas de reprodução humana assistida, o instrumento de autorização para fertilização in vitro/inseminação artificial com ovócito/sêmen doado ou cedido gratuitamente, o acordo de criopreservação de sêmen, entre outros. Analisando minuciosamente o primeiro documento específico citado, observou-se o estabelecimento, em um de seus itens, da espécie de obrigação contratada, sendo obrigação de meio e não de resultado.
