Gender, Violence, and Periphery: The Resignification of the Constitution of the Black Woman Individual in Brazil as an Expression of the Metatheory of Fraternal Law in a World of Women Citizens

Resumo: Social movements bear witness to the emerging conception of human rights on a global level, focused on daily practices to meet not only basic needs, but also effective and expressive needs, those that give a meaning and a place in the world to every human being. From this observation, the importance of the present study emerges as it addresses the contributions of the Fraternal Law meta-theory in the reframing of the black woman individual in Brazil. Thus, from the perspective of gender, violence and the periphery, as a research problem, the question is: what are the contributions of the Fraternal Law meta-theory in the resignification of the role of black women in Brazil? For the research, the deductive approach method and the bibliographic procedure method are adopted. The female body has been carrying with it the weight of a patriarchal and control culture that contributes to the removal of women from the space of equality, so we can see contributions from the Fraternal Law meta-theory in the re-signification of the woman individual, in this case the black woman from the periphery of the city, because it allows a resignification of humanity and the pact between peers. In this way, the woman from the periphery is inserted into the common space.

Los movimientos sociales dan testimonio de la concepción emergente de los derechos humanos a nivel mundial, orientada a las prácticas cotidianas para la satisfacción no sólo de las necesidades básicas, sino también de las necesidades efectivas y expresivas, las que dan sentido y un lugar en el mundo a cada ser humano. De esta observación surge la importancia del presente estudio al abordar los aportes de la metateoría del Derecho Fraterno en el replanteamiento del sujeto mujer negra en Brasil. Así, desde la perspectiva de género, violencia y periferia, como problema de investigación, la pregunta es: ¿cuáles son las contribuciones de la metateoría del Derecho Fraternal en la resignificación del rol de la mujer negra en Brasil? Para la investigación se adopta el método de enfoque deductivo y el método de procedimiento bibliográfico. El cuerpo femenino ha venido cargando con el peso de una cultura patriarcal y de control que contribuye a sacar a la mujer del espacio de la igualdad, por lo que podemos ver aportes de la metateoría del Derecho Fraternal en la resignificación del sujeto mujer, aquí dirigido a las mujeres negras de la periferia, porque posibilita una resignificación de la humanidad y el pacto entre iguales. De esta forma, la mujer de la periferia se inserta en el espacio común. Os movimentos sociais testemunham a concepção emergente dos direitos humanos em nível mundial, voltada às práticas cotidianas para satisfação não somente das necessidades básicas, bem como das efetivas e expressivas, aquelas que dão um sentido e um lugar no mundo para todo ser humano. A partir dessa observação, tem-se a importância do presente estudo por abordar as contribuições da metateoria do Direito Fraterno na ressignificação do sujeito mulher negra no Brasil. Assim, na perspectiva de gênero, violência e periferia, como problema de pesquisa, questiona-se: quais são as contribuições da metateoria do Direito Fraterno na ressignificação do papel da mulher negra no Brasil? Adota-se, para a pesquisa, o método de abordagem dedutivo, e método de procedimento bibliográfico. O corpo feminino tem carregado consigo o peso de uma cultura patriarcal e de controle que contribui no afastamento da mulher do espaço de igualdade, por isso se vislumbram contribuições da metateoria do Direito Fraterno na ressignificação do sujeito mulher, aqui abordada a mulher negra de periferia, pois possibilita uma ressignificação da humanidade e do pacto entre iguais. Insere-se, desse modo, a mulher da periferia no espaço comum.
