The Ethical Role of the Judge in the New Civil Code

Resumo: The new Brazilian Civil Code brought forth important issues on procedures to be used in civil demands. Appeals were made extinct and procedural issues were added, coupled to modifications with regard to items in civil procedure. Besides procedure changes, the new CC presented a new feature for the judge, transforming him in a particular way in an administrator of the process in collaboration with the other partners. Several tools were produced never yet seen in the Brazilian CC. This made possible a greater flexibility of procedure and the personal intervention of the judge so that the procedure becomes more efficacious and more just in the issue. Several tools have been analyzed too. It is a great challenge for judges in their high mission through the effectiveness of the process and the constant insistence of the legal status.

El nuevo Código de Proceso Civil brasileño trajo importantes novedades en lo que se refiere a los procedimientos a ser adoptados en las demandas de naturaleza civil. Se extinguieron recursos, figuras procesuales se acrecieron y modificaciones sucedieron en relación con algunos institutos del proceso civil. Además de los cambios de orden procedimental, el nuevo CPC presentó también una nueva postura del juez en relación con el proceso, que lo convierte, sobre todo, en verdadero gestor del proceso, en colaboración con las partes. Varios instrumentos se crearon para eso, como no se vio antes en el proceso civil brasileño, posibilitando más flexibilidad del procedimiento y la intervención personal del juez para que el proceso se vuelva más eficaz y justo en la composición del recurso. Se analizaron algunos de esos instrumentos. Un gran desafío a los jueces, que deberán cumplir con esta noble misión, en la búsqueda de la efectividad del proceso y de la constante afirmación del Estado Social del Derecho.O novo Código de Processo Civil brasileiro trouxe importantes novidades no tocante aos procedimentos a serem adotados nas demandas de natureza civil. Recursos foram extintos, figuras processuais foram acrescidas e modificações ocorreram em relação a alguns institutos do processo civil. Além das mudanças de ordem procedimental, o novo CPC apresentou também uma nova postura do juiz em face do processo, que o converte, sobretudo, em verdadeiro gestor do processo, em colaboração com as partes. Vários instrumentos foram criados para isso, como não se viu antes no processo civil brasileiro, possibilitando maior flexibilidade do procedimento e a intervenção pessoal do juiz para que o processo se torne mais eficaz e mais justo na composição da lide. São devidamente analisados alguns desses instrumentos. Um grande desafio aos juízes, que deverão cumprir com esta nobre missão, na busca da efetividade do processo e da constante afirmação do Estado Social do Direito.
