To Be or Not to Be: The Supreme Federal Court During the 1964-1985 Military Dictatorship

Resumo: A juridical and historical discussion is provided between political and juridical narratives on the judicial autonomy of the Federal Supreme Court during the 1964-1985 military dictatorship. Discussions on the narratives with regard to the independence of the courts and their relationships with the government provide a historical comprehension on the impartiality of jurisdiction during the dictatorship. Research deals with the 1964-1985 Brazilian dictatorship and the participation of juridical authorities, with only a slight space in juridical and historical analyses. In spite of the internal influences of the regime on the Court´s prerogatives, the latter lay within a reality in which palpable concerns were mainly distant situations of what was occurring in Brazil. Historical, juridical and sociological research applies investigation techniques to an historical and juridical analysis. Bibliographical research recovered narratives by lawyers and authorities of the regime and the Court´s space and autonomy. Research also analyzes the influence of the military regime on the functions of the Supreme Court and the manifestations of its members, with historical aspects for a deeper understanding of the issue.

En el presente estudio se plantea una discusión jurídico-histórica entre las narrativas política y jurídica en lo que se refiere a la autonomía judicial del Supremo Tribunal Federal durante la dictadura militar de 1964. Las disputas de narrativas sobre la independencia del Judiciario y su relación con la política ofrecen comprensión histórica sobre la imparcialidad de jurisdicción en el período dictatorial. La investigación se refiere al período de la dictadura militar en Brasil (1964-1985) y a la participación de sus actores jurídicos, que aún ocupan espacio reducido en los análisis jurídico-históricas. Pese las influencias internas del régimen en las prerrogativas del STF, la Corte estaba en una realidad en la cual las preocupaciones tangibles, mayoritariamente, eran situaciones lejanas de las que sucedían en el país. La investigación se vincula a los métodos histórico y jurídico-sociológico, aplicando como técnica investigativa el análisis histórico-jurídica. Se buscó recuperar, bajo investigación bibliográfica, las narrativas de juristas y autoridades del régimen y los límites del espacio de autonomía de la Corte. El estudio también abordó em el análisis de la influencia del régimen en las funciones del STF y las manifestaciones de los ministros, encaminando aspectos históricos para una amplia comprensión.O presente trabalho traz à baila uma discussão jurídico-histórica entre as narrativas política e jurídica no que se refere à autonomia judicial do Supremo Tribunal Federal durante a ditadura militar de 1964. As disputas de narrativas sobre a independência do Judiciário e a sua relação com a política oferecem compreensão histórica sobre a imparcialidade de jurisdição no período ditatorial. A pesquisa se refere ao período da ditadura militar no Brasil (1964-1985) e à participação dos seus atores jurídicos, que ainda ocupam espaço reduzido nas análises jurídico-históricas. Apesar das influências internas do regime nas prerrogativas do STF, a Corte estava em uma realidade na qual as preocupações palpáveis, majoritariamente, eram situações distantes das que ocorriam no país. A pesquisa se vincula aos métodos histórico e jurídico-sociológico, aplicando como técnica investigativa a análise histórico-jurídica. Buscou recuperar, sob pesquisa bibliográfica, as narrativas de juristas e autoridades do regime e os limites do espaço de autonomia da Corte.
