Resumo: The Federal Constitution consecrated the fundamental rights, guaranteeing everyone’s equality according to the law, defending the personal rights to life, liberty, human dignity, honor, name, privacy among others. Human beings and their internal values, such as personality rights, are defended by the juridical ordaining. Personality rights are recognized as subjective rights; they are the result of struggles and changes of paradigm, and the tribunals had a fundamental role in this achievement. As subjective rights, they represent the essential values of human personality, having the protection of dignity as objective. Personality rights, due to their essentiality, are rights necessary to human life, constituting the basis for human beings rights. In respect to personality rights juridical nature, first of all, it is urgent to verify if they can be considered subjective rights, as today we predominantly understand them, since these rights respect the incidence of the subject’s willingness over the protection of his interest.

El ser humano y sus valores interiores pasaron a ser tutelados por el ordenamiento jurídico, como derechos de la personalidad. Los derechos de la personalidad son reconocidos como derechos subjetivos; son fructos de luchas y cambios de paradigma y los tribunales ejercen papel fundamental en su conquista. Como derechos subjetivos, ellos representan los valores esenciales de la personalidad humana, habiendo la tutela de la dignidad como objetivo. Los derechos de la personalidad, en razón de su esencialidad, son los derechos necesarios a la vida huamana, se constituye la base de todos los derechos de la persona humana. Respeto a la naturaleza jurídica de los derechos de la persoanlidad, primeramente es necesario que se verifique si ellos pueden ser considerados derechos subjetivos, como hoy se entiende de manera predominante, en razón de tal derecho respetar la incidencia de la voluntad del sujeto sobre la tutela de su interés.A Constituição Federal consagrou os Direitos fundamentais, garantindo a igualdade de todos perante a lei, tutelando os direitos personalíssimos à vida, à liberdade, à dignidade humana, à honra, ao nome, à privacidade, dentre outros. O ser humano e os seus valores interiores passaram a ser tutelados pelo ordenamento jurídico, como direitos da personalidade. Os direitos da personalidade são reconhecidos como direitos subjetivos; são fruto de lutas e mudanças de paradigma, e os tribunais exerceram papel fundamental em sua conquista. Como direitos subjetivos, eles representam os valores essenciais da personalidade humana, tendo a tutela da dignidade como objetivo. Os direitos da personalidade, em razão de sua essencialidade, são os direitos necessários à vida humana, constituindo a base de todos os direitos da pessoa humana.
