Resumo: The present article has as an objective to present the characterization of the actual state of the personal data protection right regardless to bank accounts of people in Cuba, from the role of the banking secret as a practical manifestation of that right in banking institutions. To its accomplishment, it has applied methods of the theoretic-juristically and the empirical level, combined with logical operations of the thinking such as analysis, synthesis, abstraction, generalization and others like induction and deduction. The main result is given by theoretical an practical diagnosis done in a sample that reached different provinces in the country and let to offer a characterization of how it implements in Cuba the personal data protection right regardless to bank accounts of people.

Para su realización se aplicaron métodos del nivel teórico-jurídico y del nivel empírico combinados con operaciones lógicas del pensamiento como el análisis, la síntesis, la abstracción, generalización, así como la inducción y deducción. El resultado principal está dado a partir del diagnóstico normativo y práctico realizado en una muestra que abarcó diferentes provincias del país y que permitió ofrecer una caracterización de cómo se cumple en Cuba el derecho a la protección de los datos de personas naturales con respecto a sus cuentas bancarias. O presente artigo, tem por objetivo apresentar a caracterização do estado em que se encontra o direito à proteção de dados pessoais a respeito de contas bancárias de pessoas físicas em Cuba, a partir do papel que desempenha o sigilo bancário como manifestação prática destes nas ditas instituições. Para sua realização foram aplicados métodos do nível teórico-jurídico e do nível empírico combinados com operações lógicas do pensamento como a análise, a sínteses, a abstração, generalização, bem como a indução e dedução. O resultado principal está dado a partir do diagnóstico normativo e prático realizado em uma amostra que envolveu diferentes províncias do país e que permitiu oferecer uma caracterização de como se cumpre em Cuba o direito à proteção dos dados de pessoas físicas a respeito de suas contas bancárias.
