Resumo: One of the major issues of human rights is to protect them, because the effectiveness of human rights still finds social, economic and especially cultural limits. It is proposed the multiculturalism as an approach to support and respect human rights, through a process of cultural sources and legitimacy in a society. However, for this it was necessary to investigate the existence of an essentially human right that can be easily recognized by any company anywhere in the world. The dignity of the human person, the generations of rights and citizenship are revealed as a nuclear triad in the study of human rights by submitting to scholars and especially the to applicators a standard right to be seen as the best way to protect and respect the humanity rights.

Se propone el multiculturalismo como abordaje de sustentación y respeto a los derechos humanos, a través de un proceso de legitimación en las fuentes culturales de determinada sociedad. Sin embargo, se hace necesario investigar la existencia de un derecho esencialmente humano que pueda ser reconocido por cualquier sociedad en cualquier parte del planeta. La dignidad de la persona humana, las generaciones de derechos y la ciudadanía se revelan como una tríade nuclear en el estudio de los derechos humanos, presentando a los investigadores y, principalmente, a los aplicadores del derecho, un patrón a ser observado como mejor forma de protección y respeto de los derechos de la humanidad.Uma das maiores problemáticas dos direitos humanos é protegê-los, pois a eficácia dos direitos humanos ainda encontra limites sociais, econômicos e principalmente culturais. Propõe-se o multiculturalismo como abordagem de sustentação e respeito aos direitos humanos, por intermédio de um processo de legitimação nas fontes culturais de determinada sociedade. Entretanto, para isto fez-se necessário investigar quanto à existência de um direito essencialmente humano que possa ser facilmente reconhecido por qualquer sociedade em qualquer parte do globo.
