Family Relations From The Perspective of Brazilian Civil Liabilities

Resumo: Current analysis investigates the application of the theory of civil liability with respect to family relationships with regard to situations in which there is no due compliance to affection. In fact, such duty emerges from the principle of family solidarity. The reasons of family relationships are provided with special reference to the most important foundation of on which the Federative Republic of Brazil is foregrounded, or rather, the principle of human dignity. Discussions and debates on the issue of liability due to emotional and affection abandonment are analyzed. In fact, the issue requires the help of the Law and Psychology. Therefore, in the wake of the new paths on family law, affection should be investigation from the point of view of civil liability.

Therefore, in the wake of the new paths on family law, affection should be investigation from the point of view of civil liability.El presente ensayo nos lleva a la reflexión ardua sobre la aplicación de la teoría de la responsabilidad civil en lo que se refiere a las relaciones familiares, en situaciones en las cuales no hubo el debido cumplimiento del deber de practicar afecto, deber este decurrente del principio de la solidaridad familiar. Así, se busca de forma perfunctoria los fundamentos en los cuales se basan las relaciones familiares, principalmente teniendo como principal guía uno de los fundamentos de la Republica Federativa de Brasil: el Principio de Dignidad de la Persona Humana. Se resaltan, consecuentemente, las discusiones y altercados tangentes al tema de la responsabilidad civil en virtud del abandono afectivo, lo que lleva a la utilización de áreas tanto del Derecho como de la Psicología. Por lo tanto, frente a los nuevos rumbos que circundan los dictámenes del Derecho de Familia, es que se hace necesario analizar el afecto bajo el prisma de la responsabilidad civil.O presente ensaio noz leva à reflexão árdua sobre a aplicação da teoria da responsabilidade civil no tocante às relações familiares, em situações das quais não houve o devido cumprimento do dever de praticar o afeto, dever este decorrente do princípio da solidariedade familiar. Assim, buscam-se de maneira perfunctória os fundamentos pelos quais as relações familiares se baseiam, mormente tendo como precípuo norteador um dos fundamentos da República Federativa do Brasil: o Princípio da Dignidade da Pessoa Humana. Ressaltam-se, consequentemente, as discussões e celeumas tangentes ao tema da responsabilidade civil em virtude do abandono afetivo, o que reclama pela utilização das áreas tanto do Direito como da Psicologia.
