Time shaping the “proviso of the possible”: Fiscal sustainability as a fundamental group right

Resumo: | The article aims to outlook the understanding of fiscal sustainability as a fundamental right. The budget constraint of the public sector is deemed a factual and formal limit to fundamental socio-economic-cultural rights achievement. Government debt is the tool which allows to shape the “proviso of the possible” over more than one financial year, anticipating the spending of public funds. However, its unsustainable dynamics carries serious consequences for the whole society. The article identifies an additional view and typifies fiscal sustainability as a fundamental right from surveying its violation consequences, analyzing the characteristics of a group interest, and extracting its protection duty from constitutional principles and rules. The study concludes that the time limit to socio-economic- -cultural rights achievement, rather than budgetary legislation or creditors’ rights, is the present and future generations’ group right of not suffering the consequences of an unsustainable public sector financial activity. Taking fiscal sustainability as a right, instead of just a desirable goal, contributes in assessing of what someone can reasonably demand from society. |

Embora a restrição orçamentária do ente público seja normalmente considerada um limite fático e formal à concretização dos direitos fundamentais, o artigo identifica uma dimensão adicional: a dívida pública é o instrumento que permite modelar os limites do possível ao longo de mais de um exercício financeiro e antecipar a aplicação de recursos públicos, mas sua condução insustentável acarreta graves consequências à sociedade como um todo. O artigo compreende a sustentabilidade fiscal como direito fundamental a partir do exame das consequências de sua violação, da análise das características que permitem sua identificação como um interesse difuso, e constrói o dever de sua proteção a partir de princípios e regras constitucionais. Demonstra-se que o limite temporal à concretização dos direitos prestacionais não é a formalidade da legislação orçamentária, nem o direito patrimonial dos credores, mas sim o direito da própria coletividade e das gerações futuras de não sofrer as consequências de uma atividade financeira insustentável do ente público.
