Resumo: | The main purpose of this article is to make a critical approach to the ideas of the Justice Roberto Barroso, from the Brazilian Supreme Court, about the use of the expression Judicial Activism. This paper aims to conduct a brief analysis of the problems inherent in academic discussion of the expression Judicial Activism, since its birth in 1947 in Fortune Magazine with the famous Arthur Schlesinger Jr. article. We observe the uncritical importation of the expression (Judicial Activism) by the Brazilian doctrine, and we observed that this expression became a Constitutional Cliché. We analyzed the use of the term Judicial Activism by the Justice Roberto Barroso, especially in his confirmation hearings before the Brazilian Federal Senate, analyzing primary research sources (shorthand notes, articles, interviews), discovering that there was a trivialization of the term Judicial Activism. |

ABSTRACT: The main purpose of this article is to make a critical approach to the ideas of the Justice Roberto Barroso, from the Brazilian Supreme Court, about the use of the expression Judicial Activism.
