The expression “judicial activism”, as a “constitutional cliché”, must be abandoned: a critical analysis

Resumo: The main purpose of this article is to make a critical approach to the ideas of the Justice Roberto Barroso, from the Brazilian Supreme Court, about the use of the expression Judicial Activism. This paper aims to conduct a brief analysis of the problems inherent in academic discussion of the expression Judicial Activism, since its birth in 1947 in Fortune Magazine with the famous Arthur Schlesinger Jr. article. We observe the uncritical importation of the expression (Judicial Activism) by the Brazilian doctrine, and we observed that this expression became a Constitutional Cliché. We analyzed the use of the term Judicial Activism by the Justice Roberto Barroso, especially in his confirmation hearings before the Brazilian Federal Senate, analyzing primary research sources (shorthand notes, articles, interviews), discovering that there was a trivialization of the term Judicial Activism.

O presente artigo objetiva realizar uma breve análise sobre os problemas inerentes à discussão acadêmica da expressão Ativismo Judicial, desde o nascimento da expressão em 1947 na Revista Fortune com o famoso artigo de Arthur Schlesinger Jr., até a importação acrítica da expressão por parte da doutrina brasileira, observando-se que a expressão se tornou um “cliché constitucional”. Analisa-se a utilização da expressão Ativismo Judicial por parte do Ministro Luís Roberto Barroso, especialmente em sua sabatina perante o Senado Federal brasileiro, a partir de uma análise de fontes primárias de pesquisa (notas taquigráficas, artigos, entrevistas) descobrindo-se que houve uma banalização da expressão Ativismo Judicial.
