Study on the responsibility arising from the use of "unmanned aerial vehicle" (drone) in Brazil

Resumo: | The objective was to analyze the liability arising from the use of “unmanned aerial vehicle” (drone) in Brazil due to the significant increase in registered units, as well as referring to the forensic theme still under construction in the country. This is a qualitative study with a reflective character. Documentary research from a direct source was used as a method for data collection. The results were presented in a descriptive way aimed at the reality national. Concluded that regardless of its purpose (professional, recreational, commercial or agricultural) it is required that the driver ensure the conscientious use of the "unmanned aerial vehicle", respecting the regulatory administrative rules of the flight, as well as individual rights and guarantees of third parties. Failure to comply with the flight rules may generate administrative, consumerist, civil and/or criminal liability for the drone operator and the person responsible for aerovane, especially in the face of conduct that characterizes negligence, recklessness and malpractice. It should also be noted that it is essential to expand the preventive inspection related to the use of the "unmanned aerial vehicle" by the aeronautical authority, in order to minimize the risk of damage to the legal assets of third parties, aiming to avoid the judicialization of disputes in other areas of law to resolve conflicts of interest. |

Se trata de un estudio cualitativo con carácter reflexivo. Se utilizó como método de recolección de datos la investigación directa de documentos fuente. Los resultados fueron presentados de forma descriptiva orientada a la realidad nacional. Concluyó que independientemente de su finalidad (profesional, recreativa, comercial o agrícola) se requiere que el conductor asegure el uso concienzudo del “vehículo aéreo no tripulado”, respetando las normas administrativas reglamentarias de el vuelo, así como derechos y garantías individuales de terceros. El incumplimiento de las normas de vuelo puede generar responsabilidad administrativa, de consumo, civil y/o penal para el operador del dron y el responsable de aerovane, especialmente ante conductas que caractericen inatención, negligencia y imprudência. También cabe señalar que es fundamental ampliar la inspección preventiva relacionada con el uso del "vehículo aéreo no tripulado" por parte de la autoridad aeronáutica, a fin de minimizar el riesgo de daño a los bienes jurídicos de terceros, visando evitar la judicialización de controversias en otras áreas del derecho para resolver conflictos de interés.Objetivou-se analisar a responsabilidade decorrente do uso de “veículo aéreo não tripulado” (drone) no Brasil devido aumento expressivo de unidades cadastradas, bem como referir-se à temática forense ainda em construção no país. Trata-se de estudo qualitativo de caráter reflexivo. Utilizou-se como método para coleta dos dados a pesquisa documental de fonte direta. Os resultados foram apresentados na forma descritiva voltados à realidade nacional. Concluiu-se que independentemente de seu fim (profissional, recreativo, comercial ou agrícola) exige-se que condutor zele pela utilização conscienciosa do “veículo aéreo não tripulado”, respeitando às regras administrativas regulamentadoras do vôo, bem como direitos e garantias individuais de terceiros. A não observância do regramento do vôo pode gerar ao operador do drone e ao responsável legal pela aerovane responsabilização administrativa, consumerista, civil e/ou penal, em especial diante de condutas que caracterizam negligência, imprudência e imperícia.
