Political-legal frameworks dealing with alcohol and other drugs in Brazil from 2000 to 2020

Resumo: The study aimed to know and analyze the Brazilian political-legal frameworks that deal with alcohol and other drugs in the 21st century. This is a section of the Doctoral Thesis "Therapeutic itineraries of people who use alcohol and other drugs in the city of Teresina, Piauí", defended in 2021 in the Graduate Program in Public Health at the National School of Public Health Sergio Arouca, Oswaldo Cruz Foundation. In this sense, we conducted a qualitative research, based on the assumptions of documentary research, which had as a source of data, the policies, decrees and other regulations that were published in the period 2000 to 2020. The analysis was structured according to the contributions of the psychosocial paradigm. The sectors involved were the Presidency of the Republic, the Ministry of Health, the National Anti-Drug Council, the National Secretariat for Drug Policy, and the Ministry of Justice. Most of the documents were published by Health (14), Presidency of the Republic (12), and Justice (03). Despite the advances, biases, tensions, paradoxes and setbacks, the focus on alcohol and other drugs in the Brazilian legal-political instruments presented an increase in the period studied, with emphasis on harm reduction as the guiding strategy of care. Therefore, in the eye of the anti-manicomial hurricane, the care for people who use alcohol and other drugs urges a kaleidoscopic, holistic vision; it demands new paradigms and concepts, the invention of other ways to intervene and manage services; it requires resistance and an ethical-ethical-critical-political-emancipatory posture, which honors the person as a citizen, protagonist, holder of voice and turn, in fact.

Esta es una sección de la Tesis Doctoral "Itinerarios terapéuticos de personas que usan alcohol y otras drogas en la ciudad de Teresina, Piauí", defendida en 2021 en el Programa de Posgrado en Salud Pública de la Escuela Nacional de Salud Pública Sergio Arouca, Fundación Oswaldo Cruz. En este sentido, se realizó una investigación de carácter cualitativo, partiendo de los supuestos de la investigación documental, que tuvo como fuente de datos, las políticas, decretos y demás normativas que fueron publicadas en el periodo 2000 a 2020. El análisis se estructuró según las aportaciones del paradigma psicosocial. Los sectores involucrados fueron la Presidencia de la República, el Ministerio de Salud, el Consejo Nacional Antidrogas, la Secretaría Nacional de Políticas sobre Drogas y el Ministerio de Justicia. La mayoría de los documentos fueron publicados por Sanidad (14), Presidencia de la República (12) y Justicia (03). A pesar de los avances, sesgos, tensiones, paradojas y retrocesos, la atención al alcohol y otras drogas en los instrumentos jurídico-políticos brasileños mostró un aumento en el período estudiado, con énfasis en la reducción de daños como estrategia orientadora de la atención. Por lo tanto, en el ojo del huracán antimanicomial, la atención a las personas que consumen alcohol y otras drogas urge de una visión caleidoscópica, holística; reclama nuevos paradigmas y conceptos, la invención de otras formas de intervenir y gestionar los servicios; exige resistencia y una postura ético-ética-crítica-política-emancipatoria, que honre a la persona como ciudadana, protagonista, poseedora de voz y turno, de hecho.O estudo teve como objetivo conhecer e analisar os marcos políticos-legais brasileiros que tratam sobre álcool e outras drogas no século XXI. Trata-se de um recorte da Tese de Doutorado “Itinerários terapêuticos de pessoas que fazem uso de álcool e outras drogas no município de Teresina, Piauí”, defendida em 2021 no Programa de Pós-Graduação em Saúde Pública da Escola Nacional de Saúde Pública Sergio Arouca, Fundação Oswaldo Cruz. Nesse sentido, realizou-se pesquisa de natureza qualitativa, fundamentada nos pressupostos da pesquisa documental, que teve como fonte de dados, as políticas, os decretos e os demais normativos que foram publicados no período de 2000 a 2020. A análise se estruturou segundo os aportes do paradigma psicossocial. Foram selecionados 31 normativos; os setores envolvidos foram, Presidência da República, Ministério da Saúde, Conselho Nacional Antidrogas, Secretaria Nacional de Políticas sobre Drogas, Ministério da Justiça. A maioria dos documentos foi publicada pela Saúde (14), Presidência da República (12) e Justiça (03). Em que pese os avanços, vieses, tensionamentos, paradoxos e retrocessos, o enfoque sobre álcool e outras drogas nos instrumentos político-legais brasileiros apresentou incremento no período estudado, com ênfase na redução de danos como estratégia norteadora do cuidado.
