Characterization of the crime of drug trafficking based on the sentencing sentences of the Court to fight organized crime in Belém-PA

Resumo: The article aims to characterize the crime of drug trafficking through the study of the convictions of the Police to Combat Organized Crime in Belém-Pará-Brazil. It is important to analyze how Law No. 11,343 / 2006, which instituted the National Public Policy on Drugs, has been applied in real cases. The statistical technique Exploratory Data Analysis was used, from the synthesis measures, tables and graphs to visualize the results. The theoretical framework is critical criminology, when it is reflected on the selectivity of the criminal system, which seeks to understand the reasons for choosing the stereotype of certain people to be criminalized by the criminal justice system. Most of the time, the conviction is due to trafficking in small quantities of drugs and typical behaviors that could shape both drug trafficking and possession of drugs for personal use, demonstrating the existence of a stereotype, supported by the drug policy in force in Brazil.

Es importante analizar cómo se ha aplicado en casos reales la Ley N ° 11.343 / 2006, que instituyó el Sistema Nacional de Políticas Públicas en Materia de Drogas. Técnica estadística como metodología, utilizando tablas y gráficos para visualizar los resultados. El marco teórico es la Criminología Crítica, momento en el que se refleja la selectividad del sistema penal, a través del cual se busca comprender las razones para elegir el estereotipo de determinadas personas para ser criminalizadas por el sistema de justicia penal. Se advierte que, en la mayoría de los casos, la condena se da por el tráfico de pequeñas cantidades de drogas y por conductas típicas que podrían configurar tanto el narcotráfico como la posesión de drogas para uso personal, demostrando la existencia de un estereotipo, sostuvo. política de drogas vigente en Brasil.O artigo visa caracterizar do crime de tráfico de drogas por meio do estudo das sentenças condenatórias da Vara de Combate ao Crime Organizado em Belém-Pará-Brasil. Mostra-se importante para analisar como a Lei Nº 11.343/2006, que instituiu o Sistema Nacional de Políticas Públicas sobre Drogas, tem sido aplicada em casos reais. A técnica estatística como metodologia, a partir de tabelas e gráficos para visualização dos resultados. O marco teórico é a criminologia crítica, momento em que se reflete sobre a seletividade do sistema penal, por meio da qual se busca entender as razões da escolha do estereótipo de determinadas pessoas para serem criminalizadas pelo sistema de justiça criminal.
