Shared custody and its contribution to avoid parental alienation

Resumo: | The present study aimed to discuss shared custody making an analysis of its contribution to avoid parental alienation. When there is a dissolution of the marital relationship, they distance themselves, however, if there are children, it is necessary to pay attention to the legislation that establishes the obligation of upbringing and zeal for the offspring regardless of the marital rupture. In this sense, Law No. 11,698/2008 provides for shared custody, that is, parents jointly and harmoniously promote the upbringing, education and guidance of the child or adolescent. Living with parents is essential for the healthy development of children, being necessary for their emotional balance. It is understood that shared custody is a valuable instrument to break the cycle of parental alienation, a very serious violence that has consequences for the mental health of children. Furthermore, the practice of alienating the child can result in the loss of custody of the child, or even compensation. Therefore, the research is bibliographical with a descriptive character, presenting analysis of published studies and legislation. It was evidenced in the synthesis of the studies that the shared custody is an instrument that makes possible the maintenance of the familiar coexistence with the children attending to the constitutional principles in favor of the well-being of the children. The family is the unit considered the mother cell of society, so it is up to the State to regulate this coexistence in society. |

Cuando hay disolución de la relación conyugal, se distancian, sin embargo, si hay hijos, hay que prestar atención a la legislación que establece la obligación de crianza y celo de la descendencia independientemente de la ruptura conyugal. En ese sentido, la Ley N° 11.698/2008 prevé la custodia compartida, es decir, los padres promueven en forma conjunta y armónica la crianza, educación y orientación del niño, niña o adolescente. La convivencia con los padres es fundamental para el sano desarrollo de los niños, siendo necesaria para su equilibrio emocional. Se entiende que la custodia compartida es un instrumento muy valioso para romper el ciclo de la alienación parental, una violencia muy grave que tiene consecuencias en la salud mental de los niños. Además, la práctica de enajenar al niño puede resultar en la pérdida de la custodia del niño, o incluso en una compensación. Por lo tanto, la investigación es bibliográfica con carácter descriptivo, presentando un análisis de los estudios publicados y la legislación. Se evidenció en la síntesis de los estudios que la custodia compartida es un instrumento que posibilita el mantenimiento de la convivencia familiar con los hijos atendiendo a los principios constitucionales a favor del bienestar de los hijos. La familia es la unidad considerada célula madre de la sociedad, por tanto, corresponde al Estado regular esta convivencia en sociedad.O presente estudo teve como objetivo discorrer sobre a guarda compartilhada fazendo uma análise sobre sua contribuição para evitar a alienação parental. Quando há dissolução da relação conjugal os mesmos se distanciam, no entanto, havendo filhos é preciso atenta-se para a legislação que institui a obrigação da criação e zelo pela prole independente da ruptura matrimonial. Nesse sentido, a Lei nº 11.698/2008 dispõe sobre a guarda compartilhada, ou seja, os pais de forma conjunta e harmoniosa promovem a criação, educação e orientação da criança ou adolescente. A convivência com os pais é imprescindível para o desenvolvimento saudável dos filhos, sendo necessários para o equilíbrio emocional dos mesmos. Entende-se que a guarda compartilhada é um instrumento valiosíssimo para romper com ciclo de alienação parental, uma violência gravíssima que traz consequências para saúde mental dos filhos. Outrossim, a prática de alienar o filho pode acarretar na perda da guarda do filho, ou até mesmo indenização. Sendo assim, a pesquisa é bibliográfica de caráter descritivo apresentando análise de estudos publicados e a legislação. Evidenciou-se na síntese dos estudos que a guarda compartilhada é um instrumento que possibilita a manutenção da convivência familiar com os filhos atendendo aos princípios constitucionais em prol do bem-estar dos filhos.
